Our petition was approved and is in the process of being sent to the NVC.

My wife currently resides in Hyderabad, India. She went to the UK to work (but on a tourist visa) for 2 years from 2007 - 2009. Will she be required to get a police certificate from the UK? If so, who should we contact to obtain it?

Thanks!

This is what Department of State saying about police clearance certificates for indian citizens..

http://travel.state.gov/visa/fees/fees_4881.html?cid=3582

Police Records

Indian Police Clearance Certificates should be obtained as follows:

All Indian IV applicants aged 16 and above, residing in India, should obtain police certificates from the local Passport Office.

Indian passport holders applying for visas outside India should obtain a statement from their local embassy or consulate confirming they have no criminal record.

Non-Indian IV applicants residing in India should obtain police certificates from the District Police Station serving their area of residence.

Indian police certificates are not available for foreign (non-Indian) applicants applying outside India.

I think ur consulate is Chennai... if u have any doubts u can contact chennai consulate at ChennaiIV@state.gov.. They will reply immediately..and u need to send these police clearance certificates along DS-230 (Immigrant Visa Application) to the NVC..

You posted in the K3 forum. Hopefully, you already know you're on the CR1 or IR1 visa path and that K3 is no longer available.

Or go here and select United Kingdom. http://travel.state....1.html?cid=3559 where you'll find the following...

Police Records

Available. Immigrant visa applicants who have resided in the United Kingdom for six months or more since the age of sixteen are required to obtain a statement from the Association of Chief Police Officers (ACPO) Criminal Records Office. Applicants will find further guidance and application forms at the following website: http://www.acpo.poli...ertificates.asp

Consular officers who received "No Live Trace" results for an applicant should contact London's Fraud Prevention Manager for further information. The Rehabilitation of Offenders Act 1974 enables some criminal convictions to become 'spent', or ignored, after a set length of time from the date of conviction. After this period, with certain exceptions, an ex-offender is not normally obliged to mention their conviction when applying for a job or obtaining insurance, or when involved in criminal or civil proceedings. The "No Live Trace" indicates that information may be available relating to a 'spent' conviction. "No Trace" indicates a clean police record.

Applicants are legally entitled to gain access to the information about themselves under Section 7 of the British Data Protection Act, 1998.
