Aloha,

Thanks in advance to all and to this incredible life-changing site !!!

Well, things are going faster than i expected. I mean, i filled out and mailed the RFE the day i received it. And then was informed that my case was approved and forwarded before they even received it !

So, today, almost unexpectedly i receive the package 3. So i go thru it and plan on Fedex'ing it to my fiance tomorrow .....when i come across an I-134 form (affidavit of support)

Is this for me to fill out about myself?

Is this for my fiance to fill out?

sidenote - I was never asked for one in the form of a RFE, i was only asked about any spousal abuse i may have been convicted of (no, of coarse)

Would the nat'l service center disregard my financial situation, only to have the embassy in Bangkok raise the issue? and if so, wouldnt they address this to me exactly?

gosh, i hope someone has an idea on this one, it sure would be nice to enjoy turkey day and Xmas together!!

mahalo for all and any help, eric

SORRY FOR THE CONFUSION - after my wife made it to the USA, family emergency neccesatated her immediate return to her home in cambodia. unfortunately before she was able to adjust her status, thus the case was abandanded. we now are filing both k-3 (married in usa) and have petioned both i-129f and 1-130 .....so, our "journey" has once again began. thank you for all your help and understanding - appleegg and sreyon.

I-134 is to be filled out by the USC, the petitioner, who should also include the supporting documents, as per the instructions on the form and the rules set by the consulate/embassy. For example, in Brazil, even though the petitioner may not be self-employed, they're still asked to send the latest tax return.

This form is used to assess whether the beneficiary is likely to be a burden to the U.S. government. Most consulates/embassies request that the petitioner is 100% above the poverty guidelines, and some, 125%. You have to check that. If your fiance doesn't meet that requirement, you'll have to get a co-sponsor, which might be tricky (some consulates don't really like co-sponsors, e.g., Manila).

Some instructions on I-864 (used for AOS) apply to I-134: http://travel.state.gov/visa/immigrants/info/info_1328.html

Poverty guidelines found here: http://www.uscis.gov/graphics/formsfee/for...ines%20I-864%22

I only offer advice - not even legal. Just the plain and simple kind.
