What I am saying is that if he shows up and explain why he is not willing to AOS, they will either deny or give her the opportunity to present her WAVA claim. A WAVA claim is not easy. But it will let him off the hook, all he will have to do is divorce her at his leisure, or she will have to divorce him at her expense.

All of the work and expense will be put upon her to try to obtain her GC thru the wava claim if there is any creditability to it. He will be able to go his merry way, because he will not be under any obligations to her any longer. If I remember correctly there is a child involve in this marriage, that would be another court case.

Vett what part of the state is this. Also he should show up at the interview , contest it..Does he work for a government,or city ,or cty job.If so he might want to let his superiors know what going on to protect his job. Also he should put a restraining order out on her. I work as a Social Worker in Calif, for the County, so I do lots of referrals based on domestic violence. :dance:

OP you could attempt to report her to ICE and USCIS.

well thanks guys for all your replies. i feel so much for my friend he does NOT deserve it. i know he would NEVER hit her, so i know she is just trying to

build a case against him. after all she did to him she is still trying to bring him down. but karma will deal with her. she was my friend too, but now i do

not want to be her friend anymore bcuz she has shown me that she can be a viscous, conniving, manipulate witch!! i wish her all the best.

leave her to God, her day will come soon, it's women like her who make it bad for other women. i agree that he should contest it and file for a divorce.

yes that is exactly what she did. but they also has a son together so i guess she figures with that fact, plus the fact that she got him

arrested on domestic violence she has a solid case to get her green card. bcuz he told her that he was not going to the AOS meeting.when

he found out that she was cheating with the neighbor, and she told him that it's over. also she did not consummate the marriage, that is

what she and him told me.

Ok, so just a question or two. How is it relevant to their case that they have not consummated the marriage? Does the USCIS really inquire about the sexual relationship of couples petitioning for visas? Just wondering. Also, they have a son together...biological son I am assuming so it's not like they have never had sexual relations before. Anywho, I was just wondering. I think that you should stay out of this, which I think may be hard. Sorry you are losing a friendship in this but you should just stay out of it!

The laws vary from one state to another, but an annulment based on a claim that the marriage hasn't been consummated usually requires proof of an inability to consummate. For example, impotence on the part of the husband, or frigidity on the part of the wife. Annulments are almost never granted to a couple who had children together prior to the marriage. Your friend should save himself some time and money and just file for a divorce.
