It happens. Sometimes medical gets lost in transit from consulate to USCIS.

Or you did not get vaccinations transferred to an I-693 or the DS-3025 (vaccination record was not completed properly or not at all at visa medical)

Lots of time that RFE just needs a I-693 vaccination record done.

My ds-3025 is completed by the doctor, and is dated numerous times on it --the rfe states "you submitted form i-693, medical exam and vaccination record. However, the civil surgeon certified the exam more than 1 year before the date the applicant filed form I-485. the form must be dated within one year of filing form 1-485" === it was dated on 9/29/2010, and AOS filed on 1/21/2011 -- not sure why recv this RFE

Did you go to a civil surgeon in the US? The dates and the number DS-3025 sound like you're talking about the visa exam. The rfe is talking about civil surgeon and that you submitted form I-693, which would have been done in the US. Give more information on where/when you saw doctors and what you submitted with AOS as far as medical things.

How would you know if your medical was incomplete at the consulate stage, would you be informed at that stage?

I am doing my AOS but didnt plan on sending the I-693 since they said only to submit said form if your medical was incomplete, is this the correct thing to do?

AOS from K-1

3/09/2011: filed I-485 + EAD

3/11: Delivered Chicago Lockbox

3/15: text and email confirmation/Check Cashed/NOA1 sent

3/16: touched

3/18: rec hardcopy NOA1

3/21: rec biometrics appointment for 4/08 planning walk in for 3/23

3/22: successful walk in biometrics exactly 3 months since POE

5/14: touched/text & email notice of EAD approval

5/16: EAD in hand

7/1: Text/email notice for interview

8/3: Interview.............Approved!!!!

8/13: Green Card in hand

Based on what you've written is the wording of the I-693, it appears the civil surgeon put 2010 (instead of Jan 2011) on the I-693 vaccination transcription. Did you DO the vaccination transcription? Because this is the only thing that makes sense. If you have a copy of the I-693 have a look at the date to find out if it's dated wrong.

If everything is fine then I would contact your congressman/senator about the false RFE.

You're technically supposed to be able to submit the DS-325 if adjusting from K-1. Most people err on the side of caution and pay $50-75ish to get the vaccinations part transcribed onto a I-693. So let's keep it simple, and try and figure out what's happened?

What date was the DS-3025 (medical before K-1 interview) completed?

Was the vaccination history marked as complete on the DS-3025?

Did you submit any proof of payment for the medical, clearly indicating the date of the transaction?

Did you get an I-693 as well?

If so, what was the date on the I-693?

If so, did you send the DS-3025 and the I-693, or just the latter?

That's exactly what I was thinking...IF he/she saw a civil surgeon in January then maybe he dated it 2010 and that threw off the person checking the application. It sounds like a mistake by USCIS but the OP didn't answer my question about when doctors were seen so it's just a guess.

Correct -- her medical exam was dated 9/29/2010, and the I-485 was submitted Jan 2011 -- I have copy of radiography and vaccinations (ds-3025)both dated the same, as we took care of all the medical exams and vaccination in one day, I know I was there LOL -- the brown envelope (I-693) is surrendered to border patrol upon your arrival to the united states, and from there they are responsible for sending to DHS ..

I contacted my House Rep and I am awaiting response, but I also contacted immigration at orlando airport and was told by a supervisor there that everything is sent to a texas lockbox and has a tracking number assigned to it, and he is looking for the package and will contact me back.

The RFE is very vague, and doesnt tell you exactly what the problem is, and that in itself, is the problem....

What date was the DS-3025 (medical before K-1 interview) completed? Dated 9/29/2010

Was the vaccination history marked as complete on the DS-3025? YES

Did you submit any proof of payment for the medical, clearly indicating the date of the transaction?

Did you get an I-693 as well? Surrendered to Border Patrol / Immigration at point of entry

If so, what was the date on the I-693? 9/29/2010

If so, did you send the DS-3025 and the I-693, or just the latter? Sent I-693 filled out with section 1 only, with copy os DS-3025

****** update***** Recieved phone call from my Congressman's office ( Gus Bilirakis ) -- Apparently this is the most common RFE for visa's, and was informed that the I-693 is in fact the brown envelope and with the k-1 visas it is not even needed to send in an I-693 since it was already surrendered to CBP --- Was also informed that this is an issue being raised with USCIS and some upcoming hearing regarding these denials with general /vague meanings ... I remember reading something about this hearing on capitol hill, but cant find it....

I can suggest anyone with this RFE issue to contact their congressmans office!
