Hi folks,

Does anybody know whether it is acceptable to work freelance from home for a foreign company, while visiting on a Visa Waiver Program? I know I cannot have a job here, while on VWP, but I was wondering whether I could accept a freelance writer position I was just offered in my own country.

Thanks,

Mathilda

That is not an issue. You are not taking a job from a US citizen or resident, you are simply working for your job while visiting.

Not possible on the VWP.

How they would know is another matter,

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Thanks for your answers! So far we have 2 answers and to opposite opinions. It would be useful if any of you could tell me where to find info about that. What is the source of your thoughts about that?

Thanks,

Mathilda

Here is my thoughts on this.

I am a blogger, whats to stop me from logging onto my blog site and posting while overseas visiting a country on VWP?

Or I am in IT, I get a call from the office while on vacation overseas about a problem, I terminal service into the server farm to check log files and configurations by remote control.

Or I work frelance for a news paper, and am asked to submit an article I have been writing on my laptop while in vacation, I connect to the internet and send it off by email.

You see what I mean?

If you are getting paid to write a blog and post a blog (while you are on VWP) that is against the term of VWP, does not matter you do from home or starbuck or office.

While you are in US on VWP you are not allowed to work in any form. You are here as a visitor and visitor have not right to work.

Yes, work for a US company this is true. However this does not apply to working for a company back in the home country, having NOTHING to do with the US Economy.

Actually.... I don't! I just want to know whether I can do it or not, and possibly see a gov source for the reason why. I definitely do not want to do it if it's illegal in any possible form. Thanks though!

That's actually intuitively what I would think, but I would like to make sure that this is stated somewhere legit.

We are splitting hairs, here.

You are NOT allowed to enter the USA on VWP, and work for a local employer, for example you are visiting family, and they ask you if you could help out at their family business. Or take a job at the local hamburger joint.

yes if OP wants to work for company in Italy while in US on VWP - then its not a problem, but cannot work for a US company on VWP.

That was what her original question was, about performing some work remotely for her Italian job, getting paid in an Italian bank account in euros, probably automatic payments through salary. Sheesh. She was never, ever, asking about working for a US company.

OP - it's fine. People can travel for business too - to attend a meeting for their job, for instance, on the VWP. You seem to suggest a pleasure trip while checking in with work. Both are fine.

We are confusing two issues:

What are you allowed to do do (which does not include work, for anybody, paid anywhere)

What people do do. Obviously there are 10,000,000 who do work without authorisation plus I am sure many others go outside the remit of their visa's.
