k-1 AOS past 90 days- Oops!

my k-1 fiance and i returned into USA on oct 26, 2010, and got hitched on Dec. 21 (solstice, and a lunar eclipse= good luck?). But we didnt realize we needed to file for her Green Card (AOS) BEFORE the 90 days limit passed. We just thought we had to get married b4 then. Oops! Now we're finally getting around to wading thru another bunch of c**p forms and realize this. Are we gonna get in trouble?

The only requirement tied to K1 visa is to get MARRIED to the K1 petitioner within 90 days. You can AOS any time after marriage. Won't be any troubles, just follow the guides.

No. There is no time frame to file for AOS however it's recommended to file ASAP. The only requirement is to marry within the 90 days of POE, which you have done.

01/2006 - Filed k1(1st time)

04/2006 - Interview (1st time) denied

Waited, waited...... no review

06/2009 - Filed k1 (2nd time)

09/2009 - NOA 2 approved

12/2009 - Interview (2nd time) APPROVED! VISA ISSUED

02/2010 - Arrived USA

04/2010 - Married

AOS Timeline

4/19/2010-Sent to Chicago Lockbox

4/26/2010-Received texts and emails 7th day

4/30/2010-Received NOA's(Hardcopies) 11th day

5/3/2010-Received ASC appointment notice(mailed 4/29/2010)14th day

5/7/2010-Walk-in Biometrics done(2 weeks earlier)18th day

5/13/2010-Case transferred to CSC

6/2/2010- Case received/resumed at CSC

6/18,6/22,6/23 AOS touches

6/28/2010- EAD production and touch on AP

6/29/2010-AOS APPROVED

7/2/2010- 2nd update on EAD production and touched on AP....

7/6/2010- Received "Welcome Letter" and AP document

7/12/2010-Received GREEN CARD and EAD

Yep,

I have seen some go very long in filing the AOS hoping to get AOS approved after 2 years of marriage, in this case it is advisable to file an I-130 with I-485, bacause AOS based on K-1 always results in a 2 year conditional green-card.

klr650 - is no requirement for filing the AOS within 90 days of POE date, at all.

No Reg, No Law, no entry in 9FAM.

Must be married within 90 days of POE date, and thats IT.

(this is supposed to transcribe over to expiration date on the I-94, as well)

relax you, get it in when you can, soonish.

File for AOS as soon as you can, however. Otherwise, try to avoid traveling within a 100-mile radius of either U.S. border, what with inland CBP checkpoints. They have NO sense of humor. No matter where you are, have her carry a photocopy or extra copy of your marriage certificate whenever she goes out. One never knows.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Never seen the checkpoints we have along the southern border up along the northern border anywhere.

Totally off the subject of AOS, but I saw that you married on the winter solstice...our K-1 interview date is March 21...good luck for this then for the vernal equinox :)???

Removal of Conditions approved - 12/16/13

AOS should be filed before you die; other than that there is mo time requirement.
