Hello!

My wife is South African and I'm a US Citizen. I hail from Portland, OR.

Anyhow, we got married in Cyprus on May 14th, 2010 and currently live in the United Arab Emirates.

After having to work and wait 6 months here before I can even start the process, I have filed the I-130 petition for her and she had her first interview on January 13th. Her second and final interview is scheduled for April 11th, which to me is too far out. I just want to get the hell out of the Middle East and head back home.

My question is thus: Can I finish this whole process in the States rather than finishing it here? How do I go about doing that?

I'm just homesick and I hate it here. Any help would be greatly appreciated. Thanks.

When you say gets a visa, can she apply for a tourist visa and still finish the paperwork in the States?

No she has to stay in the UAE and finish the process. I am assuming you are doing DCF so you need to wait it out until her 2nd interview. More than likely she will be approved and you will be back in the US in no time.

09/08/2011 (Day 200 ) Email notification of Interview.
10/11/2011 Interview at 26 Federal Plaza, NY!
Interviewed and Am expecting RFEs!
10/13/2011 (Day ***) Received RFE-- Requesting that I provide documentation to prove I was never married in Uk or Illin
02/11/2012 (Day ***) Service request..Told its being reviewed by supervisor

24th March 2012!!!!!!!!!!! Email notifiying me of CARD IN PRODUCTION
03/26/2012 (Day 376) Emails confirming that my I-130 and I-485 have been approved.

4/2/2012 Green Card In Hand!

Unbelievable that my journey took this long but Im thankful

Next Stop Premed...Yup!

3/24/2014 Application for conditions to be removed

9/22/2014 APPROVED without interview.

Theoretically you could but it is not a finish the paperwork but essentially a do over as the processes are different. That is if she is allowed in the USA but that is not likely. I say this because a person is ineligible for a tourist visa if they cannot overcome the presumption of immigrant intent, your wife certainly has demonstrated immigrant intent, which would be very difficult to overcome so the likelihood of a tourist visa are remote

Suggest (strongly) you call into the Embassy IV unit, ask/beg/plead for an earlier interview date.

Thanks for the responses.

I spoke with the US Counselor in person and asked about my wife. She said that it's not possible while she's in the middle of an LPR Immigrant\permanent residence visa and we have to wait...

Oh, well, what to do? Another few months in this filthy sandy place..

if that was the answer - I am really worried about 'the question'.

I try again -

IF you are filing an I-130 via DCF - and you've got an approved I-130 in hand -

then the intake/further processing for the IV still has to occur

and

is possible to ask for an earlier interview date at the US Embassy IV Unit.

But you have to ask for it. Ask for an earlier interview date for the Immigration Visa.
