hi all,

What is this 'no deadline to file AOS' thing supposed to mean?

What is the person's legal immigration status after 90 days?

What are the risks normally associated with using Advance Parole 180 days after the 90 days?

Um, hon, your hubby's naturalized now. And you went DCF. All these questions just aren't relevant to you.

Since I'm Mo's answerman and shadow.. I'll take a stab :)

1) The USCIS regulations state that the I-485 should be filed promptly after becoming eligible for it... while the USCIS does not set an in stone deadline for filing the I-485, there may be repercussions if the I-485 is not filed in a timely manner which leads to the next questions

2) An individual has no legal status to be in the US between the time the K1 status expires and the time the I-485 is filed... Once the I-485 is filed and accepted, the applicant is in a "period of stay authorized by the Attorney General" popularly known as an "Adjustment Applicant"

3) As stated in question 1, an individual does not have legal status to remain in the US once the 90 day period of authorized stay for the K1 has expired. If one accumulates more than 180 days of such time out of legal status and subsequently leave the US, then one is subject to a 3-year ban on reentry. Having AP does not relieve the CBP of the statutory requirement of imposing the ban...
