Long time no post! Good to see the people who went through the K1 process same time as I did doing well. Here's the potential problem - wonder if anyone can help or i'm a lost cause:

after a LONG wait for the K1 I eventually got it in November last year and entered in December. We were married at the beginning of March (no problems so far, right? - married within 90 days). Problem is we've moved from a few addresses since as we've been travelling (we were apart a long time and wanted to catch up with various friends throughout the country whom we've been staying with - sometimes for extended periods) and as such I haven't yet filed my AOS as I haven't had a permanent address to send it to. Can anyone foresee the problems I'm going to run into if I do it now? I'm guessing it's going to be a good 6-9 months before I can get back to England for a visit, right? Get a lawyer, and what ever you do don't leave the country. All is not lost but an immigration attorney can help.

The only issues I can foresee you possibly having to overcome:

* Having not filled for AOS within 90 days

* Partner may not have steady job to support I-864 (aff. for support) requirements

* Proving you guys are a legit couple, unless you have bills, credit cards, loans, assets in both names.

Really as long as you did not leave the US and were married within 90 days you shouldn't have a problem or even be denied. The AOS just might take a while to be processed.

You can file for I-131 with your AOS if you want to travel while your case is being processed.

PS Since you guys have travelled so much you may want to look at the USCIS 'Processing Times' in various districts to see which one is the quickest and it may be worth your while moving / applying from their.. ;)

There is no deadline for applying foe AOS after you were married within the 90 days.... you do not need a lawyer all you need to do is file when you can... some people have waited 2 years or more befor they file and have had no problems.... Just make sure you do not leave the US until you have AP or a Greencard....

There is no deadline for applying foe AOS after you were married within the 90 days.... you do not need a lawyer all you need to do is file when you can... some people have waited 2 years or more befor they file and have had no problems.... Just make sure you do not leave the US until you have AP or a Greencard....

Ditto. Just to cite my own case -- my hubby entered the US on a K1 visa December 27th and we were married on December 30th, but we waited until June to file for AOS, at which point his I-94 had been expired for over two months. Our AOS case was transferred to CSC for streamlined processing, and we were approved without an interview about two months after we filed. My husband received his green card a few weeks ago. So we got lucky with the CSC transfer, but my point is that filing late did not hurt us at all.

July 1, 2006 ........ Biometrics appointment

You can also check the USCIS website to see the processing times of your local District Office. That will help you to know how long it will take them to get to yours if you file it in the next couple of weeks (rough estimate).

No problem. Piece of cake!!

There is no real deadline for AOS if you comply with their 90 day rule to marry.

Of course you are kind of in a dead zone until you get the various EAD, AP and/or green card documents to prove legal residence.

Technically any person that is not a citizen is supposed to keep them informed about their whereabouts but if you had an address and you were just visiting there should be no problem.

You should have plenty of time to get the LPR or at least the AP before you plan to travel.
