Leaving Country without Advanced Parole

Hi all,

I have a question and knew this would be the place to ask it!

I have just been offered a PhD interview back in England in 2 weeks, I filed by AOS in December after entering on a K1 Visa, I also filed for the advanced parole. Is there anyway of getting out of the country for my interview without the advanced parole? I read something about extenuating circumstances, has anyone had any experience with this and would my situation count?

I realise this is an extremely long shot but thought I'd check anyway!

INFO-PASS appointment is for this, in some cases USCIS will issue an emergency AP.

Looks like IF you are offered that PHD, you may be abandoning the AOS anyway, unless the job will be in the USA.

At least 6 months or more per year.

Abandoning Permanent Resident Status

You may be found to have abandoned your permanent resident status if you:

• Move to another country intending to live there permanently
• Remain outside of the United States for more than 1 year without obtaining a reentry permit or returning resident visa. However, in determining whether your status has been abandoned, any length of absence from the United States may be considered, even if less than 1 year
• Remain outside of the United States for more than 2 years after issuance of a reentry permit without obtaining a returning resident visa. However, in determining whether your status has been abandoned any length of absence from the United States may be considered, even if less than 1 year
• Fail to file income tax returns while living outside of the United States for any period
• Declare yourself a "nonimmigrant" on your tax returns

Green-card is for residence in the USA, having a job overseas does not look like maintaining residency in the USA. Green-card is not a "Permanent Visa" it is for living and working in the USA on a permanent basis.

Advance Parole is for entering the US. Don't need a thing to exit other than a plane ticket and passport.

Do a Google search for "Maintaining US Residency" to learn what's needed. The USCIS site also has guides.

This is true, however leaving the USA before on is issued and having it in hand will get the pending AOS canceled, and the OP will then need to file an I-130 for a spouse visa.
