Affidavit of Support

My husband and I are just beginning to assemble our package for my adjustment of Status.

I have concerns about his affidavit of support. He graduated from college in Spring of 2010 and began working immediately after but only landed in his career position in late October. As such, he has an annual income well above the poverty line, however, because he has only worked part of the year his most recent W-2's only have a combined income of $16,900 for 2010.

There is just the two of us in our household and while I had originally thought this income was enough, reading a previous post I saw approx. $18,000 and change being about the minimum income we would need. For some reason I cannot for the life of me get the PDF file with the poverty guidelines to display on my computer to confirm these figures.

Regardless, IF this $16,900 is BELOW the needed income for the two of us will we need a co-sponsor? Or will the fact that his actual income is well beyond this be enough if we provide a letter of employment stating his actual annual income? I'm also concerned because with his being a recent student his previous returns also have very low incomes as he only worked during the summers.

Any insight you guys can provide is appreciated!

Employer letter and copies of pay stubs should show sufficient income.

I would attach employer letter and copies of up to 6 months past paystubs to the I-864.

Send what you can if USCIS is not satisfied they will request more evidence or a joint sponsor.

As for problematic PDF make sure you are using Adobe Reader 8 or better, and on a Mac computer Preview won't display many of the PDF files from USCIS

Watch me get in trouble with a senoir member. But, this is what I know and very little.

2010 poverty guildlines for 2 is $18,213.00 Do not Fret yet. If currant Income for 2011 is already exceeding that and PayStubs from his employer and yours and anticipated Income for 2011 is expected to exceed the poverty line then supply proof of that. USCIS will take into consideration a recent Graduate, Annual Salary exspected. A letter from the employer will/should help as well.

I realize you have a fear of them just looking at 2010 taxes and fell you will need a Co-Sponsor to complete the AOS. Provide proof That 2011 is a new year. You don't have to File the AOS immediately and can take some time to gather Income information for 2011. Build up your savings account as much as posible in the mean time.

the new poverty guide lines for 2011 changed,for two people it's 18,387 -three it's 23,162 it's 4,775 for each additional person,you may have to fine a co-sponser.

Thanks for the update. So most would say its safe to skip an additional sponsor and apply based on annual salary/employment letter and as many pay-stubs as we can come up with? Would you bother getting into including any assets, vehicles would be about all we could include.

We just want to avoid the possibility of having to supply additional info. later and delay the process.

Thanks very much. I'm adjusting from a visitor visa.

Then moving to the AOS from Work/Student/TOURIST visa forum...

Be aware, AOS from a Visa Waiver, CAN be tricky, entry on Visa Waiver is an indication you are visiting with no intent to immigrate, USCIS has been getting hard on this lately.
