need help with visa information

Timeline

I was married to my husband in nepal in 2007. I lived with him nepal until he was aproved with his I-130 and we came to usa in may 2009. we did not have sponser so we were going to work for two years so we can be our own sponser. he recieved his EAD in august 2009. we made only $ 18,000 in 2009 and $41,000 in 2010 since they ask for 3 years income can we sponser him since only 2010 income that qualify if so what should i do next? should i go ahead and apply for AOS?

You could wait to file the taxes for the 2010 year to show the income above the poverty line. But including pay stubs and W2's for the year would serve the same purpose and you could file now.

They ask for three years of income but make the decision primarily based on the current income. So, yes, you qualify with no problem, once you've filed your 2010 taxes. Be aware that "current income" is not the same thing as "income from the most recent tax return". Sometimes the numbers are the same but the questions are different and should be treated as such.

Facts are cheap...knowing how to use them is precious...

For instance, if you start a $36,000 a year job in March of 2010, your 2010 income might be only $30,000 but your correctly stated current income would still be $36,000.
