hi,

i am in the middle of the process of AOS and just finished my biometric last friday. i have a problem with my name..after getting married from K1 here in oregon with my fiance i decided to hyphenate my surmane...ex( ana c. juan-john). but the problem is whenever i receive notices from the immigration they keep on addressing my name uncorrectly..like ana j. juan john, ana juan juan john and ana juan john. when i received the first notice i reported it right away to the uscis then they said that they will correct it. and still i keep on getting wrong name till my biometrics letter. i worry that my EAD and GC and AP will get the same name problem so i called the USCIS again and told them that i will just use my maiden name instead of hyphenated name..and what they said was that i can change my name by submitting a letter and attaching a legal proof of change name.. i went to the courthouse and inquired about it and they said i can do change my name in a legal process that will take more than a month.

But the thing is, will this name change affect the final approval of my GC. i worry that they might deny my GC if i change my name back to my maiden name.

i want a legal advice but i dont have enough money for that.. my husband doesnt care with the name and he said i can do whatever i want with my name.. i just wish that i just kept my maiden name in the marriage contract.

If you wanted your green card etc in your maiden name why did you not just apply in your maiden name?

You could always make an infopass appointment and bring your documents with you and explain and show them the misprints of your name and get them to correct it in their system.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

They can't correct anything at infopass. All they can do is put in a service request. If you receive your AP / EAD with the wrong name, write a letter explaining that there's been an administrative error and include your original paperwork containing your name hypenated. Send this back to the office that sends you the AP / EAD along with the AP / EAD and they will correct if for free. Hopefully they won't take too long with that. Unfortunately you will also probably receive your GC in the same state. Make an infopass and take the incorrect GC and your paperwork along to get the stamp in your passport. Then send your GC back with an I-90 and evidence that it's an administrative mistake. You can download the I-90 with instructions and Arizona lockbox address off the USCIS website.

I had the same problem and it was never fixed and I've had to send things back etc. I don't think that the USCIS employs the brightest pennies in the jar.
