I went to the embassy in Manila in January and was told that they will not except a co-sponsor for a K-1 Visa but they will for the K-3. I really would like to hear from someone that was approved using a co-sponsor at the Embassy in Manila. Thanks Gary

Hi Gary,

Might be best off asking in the Regional Forums HERE for responses from those that are going through Manila.

I havent even sent in my I 130 yet. I just got back from being married in the philippines this last Thursday. I am going to start the timeline ASAP. I have had little time to spare because I've been trying to catch up from being gone for 3 weeks, so the time I have on the PC is limited. What time I do have I have been concentrating on getting this I 130 filled out and sent in. The reason I ask about someone being approved for a K-3 using a co-sponsor is because of a thread I read about Manila excepting(or not) co-sponsors. It was just a simple question(Were you approved for your K-3 Visa at the Embassy in Manila using a co-sponsor). I myself will be using a co-sponsor but why even start all the paperwork if Marie is going to be turned down at the interview because of a co-sponsor. I didnt think my timeline or what stage I was at in my journey had anything to do with wether or not someone else was approved or not . The question really has nothing to do with me. But I understand where your coming from-it can really help others understand when i ask a question that pertains to myself or my wife. Thank You very much for the links. I will be starting my timeline real soon. Aussie gave me a link though to ask the question in a different area more suitable to this type of question so I will try there. Thanks Again YuAndDan and God Bless-Gary

Thanks Aussie-Once again you went straight to the heart of my question. I really appreciate your help. I will post my question there. Thankyou so very much- God Bless-Gary

Hi GarynMarie...

I had a co-sponsor during my interview (US Embassy - Manila) because during that time, my husband's ITR was below the poverty guideline since he just graduated from college and was just new at his job. But we didn't just relyed on our co-sponsor. He also provided a letter from his boss and pay stubs (3 months). At the interview proper, the CO asked about the co-sponsor then he looked at my husband's pay stub and the reason why the ITR was below the poverty guideline...he noticed that my husband just started work and he started in the last quarter of the tax year. The CO was cool with it. I guess it depends on the situation but try it anyways. The only problem we have right now is that my AOS is pending because we didn't submit a co-sponsor for that thinking that the CO at the US Embassy was ok without the co-sponsor even if we showed it to them that time. It's different here, they're more strict plus the additional fact that the co-sponsor has to provide proof of their citizenship...somehow their passport isn't enought as a proof

I hope that helped.

Thankyou so much-I have some relief now. One concern of mine though is that my income by according to Uncle Sam is below the poverty guideline. I have a dependant child which increases the poverty guideline to a limit that exceeds my taxable income. Without my dependant child my income would be above the guideline, I do also get a cash bonus every week from my boss which is not claimed on my taxes. With the cash bonus my income would be okay. Claiming this cash bonus on my taxes is not an option though. I'm wondering if it would be advisable to get a letter from my Boss stating that I also get a cash bonus every week and state how much $ my bonus is worth and then also provide bank statements showing my paycheck deposit and my cash deposit every week. My co-sponsor though is my Brother and he makes well over the required income to be a eligable Co-Sponsor. Would this be enough even if my income is not sufficient. I can also get a letter from my employer stating that Marie will be hired for full time employement after arriving in the U.S. and receiving her SS #. I also intend to be with my wife during her interview to answer any questions. My 12 year old daughter will be along also. I don't know if having my Daughter along will help or not but she really wants to be there when Marie comes home. Maybe the officer will see the desire for Marie to come home in my Daughters expressions and this will aid in his decision  Thanks Again-Gary

I thinks it's a wonderful idea to put down in writing that you and your boss are committing tax fraud. That should go over very well.

Claiming any income on your taxes is always an option--the alternative is tax evasion.

Wow-Geesh Tax evasion Huh-Gosh How stupid could I be. I never really thought of it as being illegal because its only 50 dollars a week-But I suppose whether its 1 dollar or 50-its money, I suppose it adds up- dont it ?. The whole reason I dont just ask for more money is because I cant be making more than the other guys at work. Ive only been working there for 2 months but my Boss has been throwing me a 50 dollar bill everyweek. I asked if I should claim this money he's been giving me and he said no because its not worth the added paperwork. I am very very close to the poverty guideline so I think I will talk to my Boss and insist that we increase my pay or we will have to end the 50 dollars a week. Wow Thanks for pointing it out to me.

Please everyone I Hope you wont think Light of me now and consider me a tax evader. I have always considered myself as being honest and now I feel like ####### :( . I feel like a criminal. I really feel bad people Please Please Please dont hold this against me and stop helping Marie and I on our journey- PLEASE. Gosh-Yodrak and Aussie-Im sorry guys :( All of you-Im sorry!!!! I have come to almost depend on the good people in this forum to help me and now I feel that maybe I have lost all hope that anyone will help me. What a stupid question to ask- "Should I put it down on paper that I am commiting tax evasion" I guess I will refuse the 50 dollars per week hes been giving me and claim the 400 dollars I have gotten so far on my 2007 taxes.

You know, I suggest that you'd still stick with the original plan. Have a Co-sponsor. The CO will see that you're just new in your job and I guess he wouldn't be expecting you to be above the poverty guideline. But, if you were to add your salary, will it really be above the guideline? If not, I think providing bank statements and proof of other assets aside from the co-sponsor would be a better move than putting on paper the extra money your boss gives you every week. You don't have to refuse the money your boss give you... if it helps you, right? I'm not sure how taxes are here in the US since I'm new but does your "Tips & Bonuses" appear on your W2 form? Because if it doesn't you can probably consider that as a "Tip". Going back to the co-sponsor thingy...my husband gave proof of assets (not sure if his car is an asset...nyahahaha), then his insurance and bank statements (savings and checking). Anything that shows that you can cash in something if "IN-CASE" situations happen and that you'll be able to support her once she comes here especially the time where in you'll be processing her AOS. It can take a while...I hope I was able to help you out. Good luck to you, Marie & your daughter...I'm hoping for a good outcome...

Thanks for the uplift- I have been feeling absolutely ill about this tax thing. Yes Im not sure about meeting the guideline either. I just started this new job but was only out work prior to that for a few weeks. Based on my previous job I was within 1500 dollars of the poverty guideline providing I didnt miss work or anything of that nature. Well! That nature happened, the company I worked for "out of the blue" closed there doors(small business) I had a 1 month notice-this is when a co-sponsor really came into the picture. I dont want to make a big long story out of it but your right-I think I will just stick with the original plan of using a co-sponsor and not worry so much about this "guideline". When the time comes to adjust status Im sure things will be looking more stable for me. Thanks so much for your kind words. I really needed that-God Bless-Gary
