Hey VJers Happy Saturday -

Would there be any issues with a minor travelling with one of both parents when using a Tourist Visa/B1/2? Would there be risen concern by the IO for the minor's intent.? Is it best for the minor to travel alone as we have done in the past?

It's hard to say as there is no hard and fast rule..it is completely at the discretion of the CBP officer.

Richardo, I tried to refrain from answering your post due to the fact, I am sure you already knows the answer to this question, it is a 50/50 chance. Put your self in the CBP position, how would you handle this situation, KNOWING WHAT YOU KNOW ABOUT THE IMMIGRATION LAWS, would you treat the minor as a migration intent if he arrives in the country with both parents who has Green cards. OR would you take it that they are just showing the minor their new home and he would be satisfied to just go back home while his parents resides in the US. Just do a little role play your self, and with all of the scenarios/the answers are there for you.

Good luck on whichever route you take. As always don't kill the messenger.

Hi Ricardo,

I have no experience in this but would rather minor travelling alone. On my last trip, i was questioned throughly and i suspect that maybe the officer could view that i have a case at NVC processing.

Thank you for your thoughts. Hmmm I was leaning towards him travelling alone but his parents reside in Jamaica - well at least until his petition is completed so was not certain on the intent. I think though I'll instruct them to travel solo as he did back in December.
