Hi everyone, my I-94 and passport was stolen in 1999, I had filed I-102 form back in 2006 and was denied, but I requested my I-94 through FOIA last year and received the I-94 number and entry date from CBP.

Is the FOIA Response from CBP of my I-94 Records enough to prove legal entry or will my I-485 be denied?

Did you include the report of your stolen passport, letter of explanation with the FOIA of the I-94? If not I would try that.

Although, I did not include them when I filed my AOS package but I mailed the documents today in response to the RFE.

Why you moved my thread. Is it AOS from Family not from work, student or tourist.

What visa did you use to arrive in the US? Unless it was a fiancee visa or a K-3 spousal visa or an IR-5 type of family relationship visa, then AOS is not from a family based visa even though it is a family qualified adjustment.

If you arrived on one of the above listed visas, then please let me know and I will move it back. Generally, if you are applying to adjust status from a family based visa you do not file an I-130 petition unless you entered on a K-1 visa more than 2 years ago.

If I file a new I-102 with the FOIA Response of my I-94 Records, will USCIS be able to replace the lost I-94 Card?
