Example affidavits for I-751 after a divorce

My husband and I divorced before it was time to file for removal of conditions on my green card. I have quite a lot of evidence showing that our marriage was in good faith but would like to include some affidavits including one from the priest that did our marriage counseling. Are there any example affidavits around for this situation?

Hi Catherine,

There are some sample ideas listed here under I-751 - the last 2 entries: http://www.visajourney.com/content/examples. They are Word document files.

Basically, you would like the person to identify themselves by giving name, address and contact information, then a statement about the circumstances through which they know you and your marriage or the circumstances of the marriage. It is perfectly fine if it is written as a letter with a statement something along the lines of "I swear/affirm that these are a true statement of the facts to the best of my knowledge" at the end, and then have them sign the letter in front of a notary who will then stamp/seal the letter and sign it as well. Basically, the notary is signing that they attest to the identity of the person making the statement, not that the statement is necessarily true but that the person has sworn that it is true in front of them and has signed it in front of them after they have proven their identity. The affidavits are basically in support of your application showing evidence through personal knowledge that you and your husband have/had a valid marriage and these are circumstances that show it is valid from the signer's knowledge.

I totally support your idea of including affidavits. But keep in mind that they're not required. It's only a suggestion by USCIS, if you pay attention to the wording.

By the way, I, too, included an affidavit from our marriage counselor. I think it's something very positive to include with a waiver and shows how much you cared to keep the marriage. Wish you the best with your waiver.
