Her 6 months Tourist Visa is already expired/I REALLY NEED YOUR ADVISE GUYS! PLS HELP ME!

Hello to all of you, I'm new to this site.. I just came here in the US last Dec 2010 to visit my family.. I'm here right now at Alexandria, Virginia.. my problem is my childhood friend and best friend since gradeschool is in California right now.. I told her before that I'm gonna visit her once I came here in the US, but unfortunately my mom doesn't want me to visit her and instead let my best friend to come here in Virginia and visit me, she's been here in the US since January 2010, and she's only holding a 6 months B1/B2 VISA.. No one in my family knows about it. so obviously shes already an illegal alien here in the US.. this is my 3rd time to visit my family and for now this will be my last visit since my company already warned me that they will not gonna allow me to have a long vacation anymore this year and the next year. I made a promise to her and I don't want to break her heart so I called her and tell her my only option to see her.. So my idea was since her boyfriend really loves road trips why don't they go here from San Diego CA to Virginia by driving.. I know it will take them like 3-5days to get here and she said she will ask her bf first.. but I just figured it out that she's already illegal alien here am I putting her in a risky situation? what if somewhere down the road there's some immigration officer or some checkpoints or whatever that might question her to show some ID's or status here in the US.. She'll getting married this year and I don't want to ruin there plans.. Can somebody pls give me some advice.. I really need it badly, though I'm allowed to stay here legally til April 2011, but I need to go back to the Philippines at the end of this month or else they will considered me as AWOL.. I love my job too!!! And I can't afford to lose it! PLS HELP ME TO DECIDE GUYS! ANY COMMENTS, ADVISE OR INFO IS REALLY APPRECIATED.

Well, I would simply say that any encounter has with police, or any authority, puts a person with illegal status at risk. A roadtrip across the U.S. on major highways includes the risk of being stopped for speeding, traffic accidents, etc. I don't know of any immigration checkpoints in the eastern part of the U.S., but I don't know about out west.

Are you asking if she risks being caught and deported by taking a roadtrip from California to Virginia? YES

Well, I would simply say that any encounter has with police, or any authority, puts a person with illegal status at risk. A roadtrip across the U.S. on major highways includes the risk of being stopped for speeding, traffic accidents, etc. I don't know of any immigration checkpoints in the eastern part of the U.S., but I don't know about out west.

So, the only chance I can go and visit her is to sneak out from my mom.. 

Now days you dont need any check points, even a regular pullover means cop is going to check if person is legal or illegal and inform ICE as required.

1) The girl is not an illegal alien.

An illegal alien is somebody who sneaked into the country totally under the radar, in the trunk of a car, or by climbing a border fence, or by swimming through the Rio Grande. This, incidentially is how the term Wetback came into being as the overwhelming majority of illegal aliens are coming in via the US/Mexico border. The US Government knows nothing about illegal immigrants because the were never inspected.

The girl entered with a visa, however, was inspected by CBP at the airport, so the US Government knows about her, knows her name, her birth date, her address, and a lot of other things. So she is out of status, which in its practical implication isn't much better, but she is not an illegal alien.

An illegal alien has no way of adjusting status; a visa holder who overstayed her welcome does.

2) Immigration is a Federal issue, law enforcement a State issue. If stopped by a cop, the cop is not even allowed to ask her about her immigration status, not even if he thinks the person he stopped is an illegal alien. The only people who have the authority to ask are Federal agents, such as CIA, FBI, DHS (CBP/ICE), etc. In order to encounter one of those, she would have to be close to the US/Mexico border or get caught in-midst a drug or gun raid. Thus, I think a road trip shouldn't be a high risk, unless they carry something illegal in the car.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . I don't understand what your friend's situation has to do with you

My best friend's situation has nothing to do with me.. I'm just asking for some advice cos I'm concerned about her if ever they agree on my idea which is a long driving road trip. Maybe you should read it again so u can fully understand what I mean.

What's with the "sneaking out from your mom to visit" your friend? Aren't you an adult?

It's really up to you. Nobody can decide for you. Do you want to go visit your friend? You can't go with your mom, she can loose everything if a cop stops you or her bf for something. It's not worth it. And you can't force your friend to come and visit you in Virginia.

So, it's your call. Enjoy the rest of your vacation.

Thank u so much guys for your comments.. Finally, I already convinced my mom to visit my friend in California.. I just book a ticket this afternoon and my flight will be on this coming Friday.. and also thanks Just Bob for the correct definition of ILLEGAL ALIEN and further clarifications.. and to u Boiler, yes her bf is an USC and im sure that they already talk about it with regards to her status.. thanks again for advice 
