What else can be done after file I-130

Hi all, found this forum and decided to register and share with all the others who filed for F2A for their spouses.

I filed I-130 last year around October. And was sad to see the PD move back to 2008 :angry::angry::angry:

Have a few questions, really appreciate anyone who can help me:

1. what else can be done while waiting for I-130? I heard it's not a good idea to apply for other visas, F1, tourist, etc; and they will most likely get rejected. Is that true?

The goal here is just to reunite with my wife sooner... any other options?

2. I would be eligible to become USC June this year, how long would the naturalization process take? I did a little research on the web, and some said it would take anywhere from 3 months to 2 years! Anyone know from their experience?

3. I'm assuming the process for USC would be much faster, but how fast? How long would I have to wait after I become US citizen for my wife to receive her visa?

I appreciate any help, and God bless us all...

1) Yep, especially in China, the consulates are very hard nosed about immigrant intent. Having a pending I-130 SHOWS INTENT.

2) I have been seeing times in the 2-3 month periods. Yes naturalization will allow you to get a petition sitting at NVC moving.

3) Once petition gets approved by USCIS, it goes to NVC, for Citizens, the petition gets assigned a visa number immediately, for LPR the case goes into cold storage until a visa number becomes available, for China, this can take 2 years or more.

4) As for what to do while waiting, Join http://candleforlove.com and ask questions there, that board is special to China Immigrations and the tough consulate in Guangzhou China. Also extensive information to the unique electronic process at NVC for Guangzhou. http://candleforlove.com/forums/index.php?showtopic=37703

2 years or more for spouse of a LPR.

For spouse of USC NVC time is less than 2 months when using electronic processing.

Hi Chen,

happy CNY.

for your case, i'd get to know all the steps you need to do to become a USC.

As soon as you get the naturalization certificate call NVC to upgrade your LPR i-130 petition from F2A to

IR (immediate relative). the continue with the NVC steps and the interview steps to get the visa.

meanwhile you should get all the paper work for the NVC steps, such as

1. police certificate + english translation

2. birth certificate + english translation

3. tax transcript

Isn't police certificate from China valid for 1 year?

Can the tax transcript be stale?

Police cert is valid 1 year, if the OP is still a green-card holder 1 year from now whats the point of getting the police cert??

As for Transcripts, I did not say they would get stale, however the affidavit of support (I-864) will get stale, it needs recent IRS returns or transcripts, Employer letter, pay stubs etc... these things should be acquired close to the time that the I-864 will be needed. for example if it takes more than a year to get a visa number, and have been siting on an Affidavit of support from, now, NVC will demand newer documentation.

he's turning USC in June/July/August, even if he gets the police report TODAY, it's still valid.

I only mentioned police report, birth certificate and tax transcript and follow the instructions.

i didn't mention affidavit of support and all the other stuff you listed.

Why would it take more than a year for him if he's turning USC in June to Sept time frame?

Even if it does, I would rather like to send the docs required by NVC the moment that I can instead of risking any delay because you I don't have the docs ready to go because I worried it'll get staled.

and so what if it does get stale because of any unexpected processing delay, get it again.

My wife used to live in China, now she became a Canadian and lives in Canada, she already has a police certificate from China, since the period of living in China was years ago and she does not plan to live in China, does that mean her certificate is out of date?

also is it possible to apply for an interview in CHina once I become naturalized? I heard it's much faster in China than in Canada.

My wife used to live in China, now she became a Canadian and lives in Canada, she already has a police certificate from China, since the period of living in China was years ago and she does not plan to live in China, does that mean her certificate is out of date?

Interview takes place in country of residency or citizenship, if a citizen of Canada, then interview will be in Montreal.

Will need a new police cert from hu-kou back in China, I believe family can apply for one along with an English translation.

Police Records

Generally available, reliable. Persons should apply for a certificate of no criminal record at the local Public Security Bureau (PSB) (or certain types of employers such as state owned enterprises), then make application to the notary office for a certificate based on the PSB document. Persons without a criminal record will be able to obtain a certificate to that effect. Certificates for individuals with one or more criminal convictions will list all convictions for which records still exist. The certificates purport to reflect all criminal convictions during residence in China. Police records are generally not available for the period prior to 1949. Certificates are available for those in the J-1, Z, and X categories. The GOC does not issue police records for temporary residents of China in L or F visa categories.

Thanks, just a thought may not be feasible, what if she decides to move to China and found a job there? Then she will be eligible to satisfy the residency requirement, am I right?
