It's very simple question.My wife wants to divorce me and go back home.Should we divorce before she go back home or can we do it even if she in Philippines?I just want know coz I know u cant divorce in Philippines.Would that effect the divorce process?She don't have a cond green card yet.If i divorce her here she wil be out of status i think and i don't want a forced deporatation.Just get the divorce and she catch her flight back home.

If i'm reading this right and the Dates. Would'nt a Annulment work. ? Have her sign papers either Annulment or Divorce. I'm not totally sure. But, I'm sorry this happened to you. The sooner she boards a plane the less time it will take for you to get over this and move on.

I guess it would depend upon the divorce laws in your state. When I got divorced the last time we had agreed on everything so we paid a service to prepare the legal documents and we filed it ourselves at the court. 90 days later we appeared before the judge. We were sworn in, stated we were in agreement and that we are satisfied with the details of the documents we submitted.

I bet if she prepared a letter, got it notorized, and filed it along with the divorce papers stating that she is in agreement to those proceedings then she could probably go home before the final decree is issued.

The above are just my thoughts and not meant to be legal advice.

Just get a divorce in the States first. So when she comes back to the Philippines, she has papers to show that her marriage is over. no need for annulment.

If she heads home before you get property settlement agreement (separation papers) and divorce you will most likely have to wait a year before you can file for abandonment. At least that's the statutes in my state

I have had a little experience with divorce (more than one)

Like someone early had stated, each state may be different but an un-contested divorce is easy to get without the need for lawyers.

Seek some legal advise from someone in your state and get it done there.

It is extremely difficult to get divorced in the Philippines and it cost a lot more there to get it done.

You should be able to get a divorce for less than %500.00 in your state.

Go online and draw up your settlement papers. Get it notorized for both parties. Make sure you have at least four notorized copies. One for you, one for her and at least one for the courts.

Take the settlement to the courthouse and apply for divorce hearing.

Go to hearing. Divorce is done. This is an un-contested divorce.

Some states such as Massachusetts has a period of time after the hearing before the divorce is considered final.

Some are affective the date of the hearing.

Sorry to hear your situation. You can obtain a divorce whether your wife is in the States or in the Philippines ( this is assuming your wife's presence is not required for the divorce proceedings there, although i have heard a lot of stories that this may be done). Once you obtain the divorce decree, it would be kind of you to just furnish her a copy of ir before she heads back home, she'll be needing the divorce decree for the purpose of filing a petition in the appropriate Philippine court for the Recognition of such judgment for purposes of remarriage, having said this, there is no need for her to file an annulment case in the Philippines. Note however, that the divorce decree you obtained should grant you the capacity to remarry so She shall likewise be capacitated to remarry after complying with the aforesaid petition for the recognition of the divorce decree in the Philippines. This is based on Article 26 (2nd para), Family Code of the Philippines.
