My husband was killed in a car accident last week. We have filed for our AOS and only have recieved his parole. I am not sure what to do reguarding the visa. Does anyone know what steps I need to take. We also just had a baby and I need to get dual citizenship for her can anyone help me in this area. I am not sure if I am in the right area I just need some advice on what to do. Thank you in advanced.

First I want to say that I wish you didnt have to go through this time of grief. It is a terrible thing to endure and it being early days I know you are probably still numb. I will keep you and your daughter in my prayers.

You dont have to do anything. Your daughter is an automatic UK citizen by virtue of her father. As long as he is on the birth certificate and you were married then you dont have to do a thing. One less thing to worry about at this time.

Sorry to hear about your lose!Condolences! :((F)

I really don't know what to say from the legal point of view. You are the usc(petitioner), and your husband is non us(beneficiar), right? The baby is usc, if you want to get dual citizenship for the baby I think you should address maybe to the gov. of your spouse's country or to the embassy of that country?!Based on the birth certificate you should be able to do so maybe when the child is of age?Call the embassy, see what they tell you. I hope I understood corectly! As for your husband visa petition, call uscis.

I'm praying for you and your daughter (F) I can't even imagine the grief.

You may register your daughter's birth with the UK Embassy in the USA. This is irrefutable proof of her UK citizenship, but I believe it need not be done right away. You already have a lot on your plate. Here is a link: http://ukinusa.fco.gov.uk/en/help-for-british-nationals/living-in-usa/birth-registration/

As far as the AOS goes, I don't know exactly what you can do, but I can give you some ideas. First, I'd probably call the national customer service line (1-800-375-5283) and let them know what has happened. They will probably be able to tell you what to do. If you'd like to see someone in person, you could make an Infopass appointment online (http://infopass.uscis.gov/)

Our naturalization timeline

1/14/2015 - Package received in Phoenix

3/28/2015 - Hard copy interview notice received

4/29/2015 - Interview at Chicago field office - Approved!!!

Thank you, VisaJourney!!!!!

I am very sorry for your loss.

I would make an infopass appointment and take the death certificate with you. Usually they will not accept anything from the USC (like over the phone etc) because it's not your case, and that's why you'll need to death certificate in order to close his case. The only other way is to let it close itself.

Leenie gave you the best advice regarding registering your child for UK citizenship.

Once again, very sorry for your loss
