Tourist Marrying USC in the United States after 3 months of relationship, how to convince the IO of the genuine love, any similar experience?

Hi, like what I have stated in another thread, I am currently out of status for 3 months now, since Nov, 2010. I met my husband in October 2010 and we got married in January 2011, so we've only been married recently and I am in the process of consolidating the reqs for AOS. I am abit worried although not entirely, as to the possible doubts that the Immigration may cast upon our marriage sinc it has been entered only after 3 mos of bf-gf relationship. Has anyone here experienced the same thing? Can you share your experience please, or if not, kindly advise me on how to strengthen my claims before an interview officer. Thanks so much.

Go back the country and wait for his i-130 petition like everyone else...there is no shortcut for staying permanent in US . If u over stayed in US, 100% u will be denied for another visa either or not what type of visa u trying to apply. And whoever would say their love is not genuine when trying to stay here???

With what visa did you enter and from which country?

Hi, I have a B1/B2 Visa and I came in as a tourist. My visa is 10-year multiple entry which expires in 2017, and I first came in 2006 for ten days stay only although I was granted 6 months max stay that time. It was really not my intention to stay, in fact last May 2010 was already my second visit, before my visa expired I met my husband in October, well a lot of things actually came up. He didn't want me to go back besides that I have a difficulty with my aunt where I was staying, coz she doesn't approve of me having a relationship with him. Thanks for all your help.

You can adjust status from an expired B2, just make sure you do NOT leave the country until the greencard is in hand.

The short courtship will raise a red flag. They will want to see you living together and you having common friends/ him introducing you to his friends. They will want to see co-mingling of resources (joint bank account, your name on deeds if he owns property etc), and you being listed as his next opf kin on insurance papers etc.

Thank you so much. Just a note, my B2 visa will expire on 2017 as it is a ten-year multiple entry visa, it's just my 6-month stay that expired already last Nov. coz everytime you come to the US using your B2 or tourist visa, the maximum stay is only for 6 mos. I don't really mind being checked that we are living together, because truly we are, as the marriage is real. We already have a joint bank account, and he had my name added on AT&T family plan and home phone line bills, and his life insurance as a primary beneficiary.

My fear is that I don't want to go back home if ever I'd be asked to, just to wait for his petition there at the local embassy, is this a possibe decision on their part? Because I heard of someone whose i-130 was approved but their i-485 was denied which forces the person to go back to her country.

Can my husband also make a so-called spousal affidavit, to attach to his i-130 application, besides the third party sworned affidavit that we have attached as evidence to the bona fide of the marital union?

If you overstay your multiple entry visa it becomes void.

ANything is possible, just make sure you have more than enough evidences to support your relationship. Hope for the best and prepare for the worse.

My husband did not make a spousal affidavit. We requested our friends and relatives to do that for us. Lease agreement both on your names, joint accounts, insurances, emails, greeting cards [Xmas & birthdays], photos, utility bills under both your names,etc.. Evidences of a bonafide marriage are written on the I-130 instruction. You can use the guides here too and use the search function.

Now I have 2008, 2009 and 2010 W-2s of my husband, and only 2008 and 2009 internal revenue service transcript of tax records. I am writing an explanation as to why the 2010 IRS transcript is not yet available because my husband needs to file his w-2 for 2010 first before a copy of irs is received. He works at Wallgreens and the only proof of employment he has is the paycheck they receive from WALLGREENS. Is it okay if besides the above docs, we photocopy at least his 2 recent paychecks from WALLGREENS?

Well, it sounds like you are organised.. and that is ALWAYS a good thing. People adjust from B1/B2's all the time. You might get grilled a little at your interview over the short-courting period you had, but, with this can be overcome by showing pictures, your joint names on bills/leases and of course honesty.

Do not worry about over-staying your B1B2, this is forgiven for immediate relatives of an american citizen, (that is what you became when you guys got married).

Like mentioned earlier your 10 yr visa does not count - as soon as u over stay your visa it gets voided and u become illegal. You can do AOS while you are on B1/B2 but be ready to be grilled by the officer.

He/she would want to know lot of things about how you guys decided to marry in jiffy and why u had no intentions of getting married when u entered 2nd time on tourist visa.
