What if a baby is born during K-1 process?

OK, someone asked me this yesterday. If a baby is born to the beneficiary&petitioner during the K-1 process, what happens to the K-1, and what needs to be done to get the baby into the US? Does the K-1 process start all over again or can the child be added? I'm sure this has happened before.

you would report the birth abroad to a US Consulate and the child would be considered a USC.. me believes.

The K1 is as normal.

But you have to apply for the baby & I don't think it's that easy, as the baby is not born in the US or to a USC (if this is the case).

Any child of a US Citizen is automatically a US Citizen. You just need a certificate of citizenship from the local embassy if the child is born abroad. I doubt the beneficiary parent can get that, probably the US Citizen has to be there with his passport and the kid's birth certificate showing him as a parent. You don't have to petition for the baby's immigration, however.

If the child is born to the biological parent of a US Citizen (either mother or father) than he/she is automatically a U.S. Citizen. However, you have to go through a process of claiming U.S. Citizenship, which I think is as simple as the process of getting a birth certificate is.

That would imply that the baby can travel to the US on the petitioners passport, or would the baby need a passport too?

There would be no change in the K-1 processing? The K-1 lists the beneficiaries children so it would be incorrect as soon as the baby is born.

The baby WILL need it's own passport before traveling. A U.S. Passport of course. So, you'd have to wait for processing of that before traveling.

The Babies birth has to be registered at a US embassy and a passport obtained for the baby...

The K1 continues as normal and if approved the mother and baby can travel to the USA.... the baby does not need to be listed on the K1 as he/she is a USC from birth...

You may be asked to prove that you did not have the baby to expedite the K1 process.

heishe and Cass,

Not necessarily. There are some conditions that in some cases will mean the child is not a US citizen.

garya did not give enough information to determine whether or not the child will be a US citizen.

Obviously, in Majizee's world, all babies come with a K1 visa taped to their forehead when they come out!

Can we get rid of this troll? Sometimes the ####### s/he posts is kinda funny, but it's really not okay to be spreading misinformation to people with real questions!
