I am so sorry to read that your fiance was denied his visa. I was looking forward to hopefully reading good news from you! I am surprised you were able to get married so soon (I thought there was a wait of at least a couple of days or something). Anyway, I guess you have chosen your new route. Upon return to the USA you need to file the I-130 and petition for your husband to try to get the CR-1 visa. You need to get your Dominican marriage certificate translated as USCIS will need the translation of the original Spanish document.

You could file your I-130 petition as a DCF (Direct Consular Filing) only if you were living in the DR. I have read that you would have to be a legal resident of the DR and have a cedula (ID card) in order to be able to file DCF. Yet, it sounds as though you are returning to the USA and does not seem as though you are planning on living in the DR for now. Now, I wish you had considered your situation more carefully and would have consulted with other people who have gone through the process in the DR (such as the people in the Dominicans to the USA website). I am sure they would have advised you to get married and file for the CR-1 and not bother to try to get the fiance visa because of the potential red flags in your relationship. At any rate, stay strong and look forward with a positive mind to plan B. I hope someone with more knowledge can tell you whether you need to write a letter to USCIS to withdraw your I-129 F petition in order for your upcoming I-130 to be processed.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

thank u so much i also wish that i would consulted someone too and not wasted my time and money but i still stand true to my relation ship and going trough everything.. i was able to marry because i have my dominican cedula and all my dominican stuff i have never let it expire and also that we are from the same town and was able to get my birth certificate that my grandparents have and i had my sons org certificate w me also. the judge that married us is a very good friend w my uncles wife that's also a judge in nagua that's why we were able to do it so quick i do thank god and look forward to getting this over with someone told me that i shouldn't file right away and i don't know what to do?????

Why shouldn't you file right away? You married right away, so why would it be damaging to your case to file right away? Think about it, you married right after the K1 visa was denied just in time before you returned to the US. Would waiting weeks or months to file to I-130 change that fact? Why shouldn't you file right away? You married right away, so why would it be damaging to your case to file right away? Think about it, you married right after the K1 visa was denied just in time before you returned to the US. Would waiting weeks or months to file to I-130 change that fact? No. It would only mean that your case would take longer to complete.

i honestly don't know i went too see an actual attorney yesterday and they advised me that because of the bbs situation she said so they wont think its a fraud it made no sense to me either that's why I'm asking for advice i feel im very prepared to demonstrate that the relationship is true but i really don't know what to do i'm sooooo frustrated.. :wacko::crying: :crying:

How would filing 6 months from now or 1 year from now change the fact that your SO made a baby with another woman during the time that you were in a relationship? The child is still going to exist. She will only be older, she is going to be 15 months, 21 months, etc. How is not filing now going to change the facts?:

a) Your SO was denied the K1 visa.

b) Your SO has a baby daughter with another woman.

c) You married the same day of the K1 denial.

d) You will have to file the I-130 if you intend to bring your husband to the US to live with you. If you wait to file it just means you will be together as a family in the US later rather than sooner.

I am sorry, but the lawyer's advice makes no sense to me. Of course, I am not a lawyer and since you went through the trouble of getting professional advice I suppose it is best that you follow this advice as not to waste your money.
