W.H. charges 'activism' in ruling

Judge who?

The White House says a ruling by a federal judge against the new health care law is an example of judicial "overreaching" and "activism."

"This ruling is well out of the mainstream of judicial opinion," Stephanie Cutter, an assistant to President Obama, wrote on the White House's blog after Judge Roger Vinson in Florida ruled that the entire law is unconstitutional. "Today’s ruling ... is a plain case of judicial overreaching. The judge’s decision contradicts decades of Supreme Court precedent that support the considered judgment of the democratically elected branches of government that the Act’s 'individual responsibility' provision is necessary to prevent billions of dollars of cost-shifting every year by individuals without insurance who cannot pay for the health care they obtain."

A senior administration officials said the judge's analysis of the ruling was “odd and unconventional” and expressed confidence that the decision won't stand. “A good deal [of the analysis] is built on sort of, rhetorical conjecture,” an official told reporters on a conference call. “Obviously this case will be appealed. ... This is not the last word by any means.”

The official also warned that people “should not view this as the government shutting down its implementation efforts.”

Cutter, on the blog, accused the judge of putting "all of the new benefits, cost savings and patient protections that were included in the law at risk." She added, "We don’t believe this kind of judicial activism will be upheld and we are confident that the Affordable Care Act will ultimately be declared constitutional by the courts."

The Justice Department said it will appeal the ruling.

Court rulings are not a basketball game. 12-1 in favor means Obama loses. ONE ruling that it is unconstitutional means it is unconstitutional and the other 12 are wrong.

Yes they can appeal it, then it can be appealed again to the Supreme Court. what do you thnk will happen then? Which side of this issue do YOU think is anxious for the Supreme Court to get this case?

If you feel insulted, you should report it.

As I said, that would require those assigned to their duties the ability to work in an unbiased environment where they handle appropriate business as they 'volunteered' to do.

There have been multiple instances reported of abuses by Steven and AJ particularly. Direct bashing that gets either ignored or blatantly allowed to stay.

Kriskit, Otto, and Kathryn should all recuse themselves from their positions/this forum. Their actions over the course of the past few weeks and what they have paid attention to and what they allow to 'slide' on by because they adhere to a few individuals around here, is ridiculous.

Steven's comment isn't the first similar one he's made and AJ has done it multiple times as well and has gone ignored/left in place.

Though someone dares to mention that perhaps Steven should 'learn to read,' then that thread gets edited out for that part and comments made about TOS violations.

No Kathryn, you're not biased at all. :rolleyes:

But the good news is that Obamacare is ruled unconstitutional. I am sure this will be no problem for Obama who will now spend millions more to ram something down our throats we never wanted to begin with. It already cost the loss of the House of Representatives and effective control of the Senate.

I am anxious for it to go before the SCOTUS, aren't you? I really wonder how they will rule on the government being allowed to FORCE you to buy insurance. :whistle:
