Interview Date Questions

I received my notice for my interview today, yay! I just had a few questions about some of the items I need to bring with me on the day of. One of the items asked for is a federal tax return from the most recent tax year. Is this asking for mine or my petitioner? Can anyone just give me a exact breakdown of what to bring? Thanks!

Also, my interview is dated for March 2, 2011. I had also applied for my EAD and AP along with my AOS. I had my biometrics taken on January 19. I am set to travel on March 17. Is it normal that I got the interview notice before my AP and EAD? Does that mean they are processing my green card first? I just don't want to get stuck without my AP and be unable to travel on my set date. Any help would be gladly appreciated!

If you pass the interview, the officer can stamp your passport as an advance substitute for the green card itself. If the interview is successful, make sure that he/she knows of your plans before you part company.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

1) They want the latest tax return of the petitioner, not the beneficiary as the petitioner is responsible for your support even if their was a joint sponsor, the petitioner is still responsible.

2) An alternative to waiting for the interview and asking for the stamp in your passport (I-551), you could apply for an Infopass appointment. This allows you to go to the local office in person and explain the need to expedite the AP documents even though you have the Interview scheduled already.

Good luck.

The AP and the GC interview are on two separate timelines. The AP is processed at the National Benefits Center, and will be approved automatically somewhere around 70-90 days. The GC interview came early to you (compared to EAD/AP) because your local office has openings for interviews. If you are approved at your interview, you can ask for a stamp, as specified (although most offices are somewhat reluctant to give them out lately). Note: If you are approved at your interview, you will be a LPR and can no longer use AP anyway (if it got to you before then). The GC and your LPR status invalidates your need for and ability to use AP. You will need a stamp or the GC itself to travel on March 17 (if you are approved on March 2). Good luck!

But do they usually process the AP first? I'm scared that I won't get it in time...If I bring a copy of my itinerary to the interview will that help me get a stamp on my passport? And this stamp will let me come back in with no hassle right?

Even if you got AP before your interview, if they approve you at your interview, then you cannot use the AP anymore. Yes, bringing a copy of your itinerary to your interview to ask for a stamp is wise. The stamp will let you come back in, yes.
