I wasn't making a joke. I am amazed a judge would talk about broccoli in comparison to health care.

Not at all. Read the judgement and see why he said it. Then after that substitute the word broccoli for anything else.

I's just like to say that I just skimmed (admittedly did not read the entire thing) the Order Granting Summary Judgment.

Because I was just looking for the broccoli bits.

Now keep in mind I worked in the legal profession for about 15 years so I know what makes up the parts of a pleading.

In the section where broccoli is mentioned, the writer also talks about houses, cars, and bread. He cites case law supporting rulings that support his view of the commerce clause.

This is what judges and lawyers do when explaining why they have come to their conclusion- the actual judgment. It's called "citing" and basically it boils down to trying to pin-point how many other lawyers agree with your opinion through other case law.

In other words, it's the judge's opinion.

All I'm saying is don't make too much out of broccoli. He also talks about guns in that pleading. Interesting read actually.

Actually Pual the Act starts the tax with ships entering from foreign ports, but part 2 includes all ships plying the coastal trade.

Again, this is no 'individual' mandate. This is an employer mandate and this only applied if a license expired. Otherwise you were 'grandfathered' in to not have to do this.

Requiring employers to do something, is very much different than requiring individuals.

ALSO 'open water' rules are quite different than land rules. You can get by with a lot more when it comes to the sea, than you can on actual US soil. Anything else would be outside the scope of the constitution to regulate a business. A sea vessel belongs to no individual state, therefore is able to be regulated by the commerce clause.

Hey lets go with this broccoli thing! So if broccoli is like healthcare that means I can go into a grocery store because I need it or I die and then get it and never pay for it. Then the other shoppers can pay for my broccoli on their purchases.

Yeah! I wish the grocery store was like our current health system!

Suck it biotches! Pay for my broccoli! Don't mandate that I pay for my vegetables!

So because the early govt. regulated one industry in a time of need we're to assume govt. has the right to regulate all of us now?

Where's the follow-up on what happened to this old merchant's healthcare act? Is it still in effect? Are all mariners still required to pay for that hospital? Do they still pay 1% tax?

Amazing that something so important was codified into law but not amended into the US constituion.

When I read through them, I didn't see what happened to this act and how it pertains to modern day politics. All I saw was someone arguing that this singular act meant the founders were in favor of public healthcare. Did I miss something?

I'm often saying a singular amendment means we're to own guns so our govt. doesn't get tyrannical yet that's stricken down as mere hogwash. How can you decipher this act means we need public healthcare today when you can't even tell me what happened to it after it's passage? I'll admit, your links clearly say one guy argues that's what it means (and I guess you agree with him) but that doesn't necessarily answer any of my questions posted above. Care to take a stab at them? Any of them?

Not my links. Links are in the original post. Which clearly tells you what agency grew out of the Act. Reading the link and following other links off of it, gives the reader some legal theories about what this Act might have meant from the Founders standpoint and how it relates to modern arguments against constitutionality of the Affordable Health Care Act.

So it's just a discussion, slim. Discussions are nice. They occur among people who don't mind opening up their brain a teeny little bit.

Lastly, I have not disputed that a single amendment means we can own guns. I and others have tried to give you historical evidence that the wording does not SPECIFICALLY imply that the amendment is there to protect ourselves against the government. I would say you have been far less than open-minded regarding these discussions. Trying to help you understand this perspective does not mean that I think the amendment is any less far reaching than it is. It's just trying to give you a little history.

slim, I'm not your mother. I'm not going to spoon feed you. I often start reading something on ye old interwebs and then start following links. About all sorts of things from all sorts of perspectives. It's your business if you don't want to.

And yes, I rarely accept things as written. I go seeking other things that are written about the same subject. Call me bored or whatever you like.

"Necessary to the security of a free state" means any number of things to mean. Invaders from Mars, for one.
