hi everyone i have a question, can someone please help....my wife is on disability due to an illness but she does make enough to sponsor our family...2 and me make 3...she makes 23,580.00 yearly and the poverty guidline is 22,887.00...she sent out the affidavit of support and then they asked for more info and she sent it to them and now they say it wont work because she does not claim taxes...if she makes enough for our family to sponsor me why would they do this...it never said on the application that if you are disabled you can not sponsor your wife or husband...does anyone know about this matter, and what should we do.

What do you mean she don't claim taxes? Are you trying to say her income can't be varified thru IRS records/Tax returns?

when you are on disability you dont claim taxes...

I am not sure but is that considered to be means-tested income? I believe disability income is considered means-tested income which can not be used to satisfy the income requirement. I asked someone here on the base headquarters and thats what they told me. Sorry, hope that info will help you. Can you find a co-sponsor to help her qualify? Oh my friend said its considered means tested public benefits. Maybe thats why they no accept it?

Dear Fellows,

I have talked to NVC op this morning, They haven't put my mother IV packet in the system yet. Even my AVRS still giving me same message documents missing and sent checklist on 2/16. According USPS tracking info, NVC received on 2/22. How long does it takes to file put in the system? I have seen so many Vj'ers got case updated after receiving of their file 2-3 days. I think NVC is backlogged once again..I hope there will be NO SNOW FALL!!

They are backlogged. They received our ds230 last Tuesday and when I called this morning they said there was no record, then after checking further she said they just received it for processing so it's about 5-6 business days backlog. Best of luck!!!!!!! :thumbs:

Don't staple anything. I would use just paperclips or something. That's what my husband used when he sent in our I-130 package.

I stapled and used paperclips and used binder clips , I dont think it matters. Just make sure you put the Barcoded Cover sheet on front of the whole package.

Yeah, they won't issue an RFE if there's staples, but I figure it's easier for the person reviewing if you use paper or binder clips that can easily be removed if needed.
