No, I saw the metaphor. But it's still irrelevant to the OP's question.

He is requesting information about a waiver in order to petition for a second I-129F in two years and 3rd overall. He's not asking for relationship advice. His is a serious and important question that doesn't get answered clearly around here, as is apparent from the responses in this thread.

Hi,

I am preparing my 3rd I-129F.

Both the first two were approved for interviews with original papers.

I heard somewhere that after your second I-I29F it becomes more difficult.

Could any one help me on this?

What additional information do I need to send. I want to make sure I do everything correctly to get a fast process.

If there are other topics on this subject, please provide me the link or info.

You need to file a waiver since you have had two I-129 F petitions approved in the past. The instructions of the I-129 F petition form have a paragraph on this issue. Just curious, did your other two fiancees come to the US and did you marry them or did the process end earlier? (Remember to include in your packet divorce decrees or death certificates of ALL marriages).

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

More info:

Each woman was given approval to go to the interview but neither went to the interview.

The 1st 1-129F was filed on Feb. 13, 2003, the petition was returned to the US Citizenship and Immigration Services with a statement from the consular officer that the beneficiary was issued a fiance(e) visa based upon a different I-129F petition filed. I have the Notice of Automatic Termination dated March 3, 2005.

The 2nd was filed on March 18, 2010. It was automatically terminated officially on 12/7/2010 (the relationship ended back in April 2010). My fiance(e) requested the termination less then two months after the I-129F was mailed. She never gave me a reason for the cancellation. I have the Notice of Decision letter from the US Citizenship and Immigration Services which says the petitioner requested the withdrawal of the petition (even though it was my fiance(e) that requested the cancellation).

So I plan to send copies of each letter along this I-I29F application.

So I just need to ask for a waiver? Do I need to explain why the first two were not approved?

Is there more information on this topic somewhere?

I think it would be a good idea to include copies of your letters (which explain what happened to the two previous petitions) along with your waiver request.

Can you explain exactly what the waiver request is? Does the OP need to submit additional forms such as the aforementioned I-601?

I don't pretend to have an exact answer on how to file a waiver, only an approximate one, and I even missed a point, corrected by someone else, that you file the waiver request with your new I129f and not before. But that was still more than the OP knew, so at least it got him started.

But I stand by my decision to offer unsolicited relationship advice. If I see a pattern of conduct by the OP that is working against his interests, I point it out to him. If he chooses to ignore it, that's his right and no problem with me. But at least I told him.

There is no fee fir the waiver; it's just a simple letter describing the previous petitions and a short what happened. Sounds like you are good to go; I've never seen those get denied.

There is no max limit to the number of petitions you can file; depending on the country expect the fiancé to be questioned about knowledge of the previous and possibly the validity of the relationship.

MCat filed for five also.

Personally I don't have a problem with this. If an OP wNts to remain anonymous there is plenty of info on the waiver process available here on VJ to be found by performing simple searches; none of the info provided (correct info) is new and has been rehashed many times in the recent past.

Yes I too see a pattern and the OPshould ensure his present fiancé attempt knows the entire situation of those and be prepared to be faced with extra scrutiny at the interview. The timing between attempts ( I am assuming each visa petition was/is for a different person.) is subject to suspicion of intent of immigration.

She was talking about me. I apologise. I read waiver and the I-601 mentions K1 but I probably didn't read it thoroughly enough.

Regarding a limit I remember reading that many many times.. especially in relation to MCat and how there was a limit so he can't apply for anymore and his last was his 4th (from memory).

If I'm wrong oh well but the OP has his answers. Waiver filed with the K1 petition. Rate of success of the waiver is apparently fine. So good luck to him.

Where is it written that a person needs waivers for less then 2 years since last I129F filed?

Hey don't feel bad I had filed 2 k-1's also. What I did this time different. Switched countries and got married this time. I also found a great girl too! I explained everything to her. She laughed even though it was not funny. No one came here only one was interviewed. It took 7.5 months to get out of the USCIS. I hired an attorney who has since caused me a 3 month delay. What an idiot. He is now going to email my papers to the NVC after 3 months of waiting for him. He sent them by Fed ex the 2nd time. The first time I don't know what he did, but he said he sent them. It's now 1 year and we don't have an interview we are going crazy waiting for her to get her interview. You have 2 strikes against you.

You are going to be scrutinized for sure. As I am and have been including interrogated at the POE into the USA. Good luck and I hope this one is the one.
