No I did not get a stamp or anything she was just telling me that i am not in trouble i can still travel by getting a stamp downstairs, she was just giving me general info since i asked am i being deported? what i can and cannot do?

Why didn't you get the stamp? Even if you don't travel, it is good to have. Regardless, you still have your extension.

I think you have a good chance at this. Wish you hadn't said your wife wasn't abusing you. I know you wanted to support her, but lying to immigration is always a bad idea. The woman clearly knew what was going on. She saw your love and the indifference of your STBX.

Now is your time to gather all of the evidence that you can muster to prove that you entered into the marriage honestly. Document! Get a letter from your work, too about your current financial situation so they can see that despite the fact that your STBX is still responsible for you, that you are financially OK on your own.

Glad your wife went with you; sorry it didn't turn out the way you hoped. So long as she's seeing another man, you can expect this kind of behavior. I think you should also document the cheating because it comes into play. You didn't leave her, she left you.

Keep us informed on your situtation. Maybe they'll surprise you and just process your application.

I completed my biometrics today, and I talked to my attorney and told him our story what happened at the interview. According to him, it is very good that my wife came to interview with me. Also, he said I have a big chance of getting approved without have to refile I-751 again, because we were still married and the officer could tell by our story that we were really married but it is not working anymore. He said wait for 30 days what they are going to send you in the mail and call me after that.

11/07/08 (Day 17)- Biometrics Done Early walking in Norridge,Illinois

11/17/08 (Day 27)- Request for Evidence letter for I485 (they were asking for I94 Arrival record) It took 5 days to arrive online letter was sent 11/12/08

11/18/08 (Day 28)- Request Evidence is I94 sent along with I20,( I was a student), NON immigrant visa page on the passport, also, approval letter of F1 status, because i changed my status after i came to USA.

We're pulling for you!

Just remember -- tell the full truth. Your wife put you in a really tough position. She was abusive and they can't really do anything to her if you don't press charges, so don't be afraid to share that tidbit. It is important. You would have stayed even after she was bad to you so this just shows how "good faith" you've been.

12/21/2008- Sent RFE

01/03/2009- Successful biometrics. (Had contractions throughout the whole appt.) Had my Son the same day after biometrics.

01/22/2009- EAD Approved

02/02/2009- Received EAD.

03/23/2009- Received appt for interview. 04/15/2009

04/15/2009- Interview lasted for less than 10 mins, and got approved! :)
