Hi! My name is Talean. I married my husband in Pakistan this past august, but we were dating from february of last year, while i was living and working there. Things got a little to rough for me over there, so I came back to the US at the end of august. I have just established myself and finally have the money together to apply for him ( i have a co sponsor, i work and i'm a full time student). I have successfully applied for my ex husband as well and he is now a citizen, but he had resources and family memebers in the us, so it wasnt that hard. I'm alone doing this by myself. I just want my husband to be with me asap. I know i have to file i-130 first, but what would be the fastest way to get my husband here... can anyone give me suggestions? i would like to make a decision within the next week... thank you and look forward to more discussions

Unless you qualify for an expedite, there really is no "fastest way."

Follow the guide for the CR-1 visa. that is the fastest way. The I-129F will be administratively closed at NVC so don't even send the petition

The K3 is dead, the CR-1 is your only option. This is, unfortunately, not a fast process. Count on 6-8 months minimum, and as a Pakistani male, he will likely face AP (Administrative Processing) after the interview, which can be anything from a couple of weeks to a year or more.

If you don't mind saying, when did you petition for your first husband, when did he get citizenship, when did you divorce and when did you get married again? There is a potential red flag there if these things happened too quickly.

what will happen if i send the i 129f? why is this being closed and why is it not saying so on the website. my ex; we were married for 7 years. i petitined for him 6 months after we were married, but i applied for him the us embassy in japan and we were living together in japan for over a year before we came to the us together. we divorced 2 and a half years after he received his citizenship. will they guide me on what to apply for next when they approve the i-130? sorry just confused...

If you send an I-129F after sending an I-130, the USCIS will tie the two petitions together and approve them simultaneously and send them to the NVC. The NVC will administratively close the I-129F leaving only the I-130 active. The K3 is still officially on the books even though it is nonexistent in practice. As long as the K3 remains on the books, it will continue to show up on the website.

USCIS only started tying I-130 and I-129F petitions together last year. The K3 was created at a time when I-130's moved at a snail's pace compared to the pace of I-129F's In recent years, I-130's and I-129F's move at a pace that is about the same.

Just file the I-130 and don't waste your time with an I-129F.

The above is not correct. USCIS has been tying the petitions together since November, 2006. It's NVC that changed their policy last year.

Re: your ex you should be fine, as you had a long relationship before the visa and after, too.

You will get paperwork once your petition is approved, but look to the Guides here so you know what to expect and can p;repare ahead of time, it can save you weeks in the process.
