Although my 129-F was approved, when my fiancee and I went for the interview in Santo Domingo, DR they gave us a hard time about a 15 year old conviction that I have for misdemeaber assault and battery. My attorney says the circumstances do not apply to anything in the immigration visa process, yet the consulate asked for all the court records, police recors etc. I had my atty Fedex copies of everything available and it was brought to the consulate on 12-13-10. On 1-17-11 my fiance received a letter in the mail from the consulate stating that they had reviwed all the documents and that they weren'r sufficient. They are now asking for police records (which do not exist because the police dept only keeps them for 10 years), court transcripts (which was already given to them) and something called a "record de libertad". My atty has no idea what this is and we have both checked the internet to no avail. Does anyone know what it is they want? Also, my atty has sent an e-mail to the State Department regarding this because according to him my record is not pertinent to the visa issuance but we have waited over 2 weeks and no response from them yet. I'm very frustrated by this whole situation and don't understand the hassle.

Could they be asking you to get FOIA papers?

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

The Freedom of Information Act (FOIA) is a federal law that allows for the full or partial disclosure of previously unreleased information and documents controlled by the United States Government.

I was looking up "record de libertad" like you listed and that came up "fredom of record"

Thanks everyone for your input. I've found out that basically this "record de libertad" equates to the C.O.R.I. which documents the fact that you either served a sentence, were paroled or completed probation and are now "free"
