Birth Certificate for US fiance

Hey,

My fiance and I are trying to complete our I-129F petition and we are not sure if his birth certificate needs to be an original or if I can be a photo copy?

In the instructions it says copy...that is photocopy. If they need the orginal, they will ask you for it. Or better yet you can use a copy of his passport instead. see page 2 here: http://www.uscis.gov/files/form/i-129finstr.pdf

Removal of conditions Journey

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

I have heard of cases where the service center issued an RFE because they wanted a certofied copy EVEN THOUGH they were dead wrong about it.

My thinking is that it is better to spend the $20.00 or so to get the certified copy and avoid the RFE.

We just used a copy for i129f packet and gave an original one for the interview at the embassy and we were fine :)

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

No I do not. Direct knowledge requires it happening to me, which it won't since I sent in a certified copy.

We are talking 20 bucks vs. playing the RFE lottery. It is quite clear to me which one is the better choice.

You only need to send in a copy original is for beneficiary at interview

I agree with you, as you are absolutely right. But I am not going to argue with the service center if they tell me otherwise because I am the one who gets the RFE, totally avoidable by spending the 20 bucks.

Some arguments are worth winning. Here, when the winning is 20 bucks and the possible loss is an RFE, I still think it is prudent to spend the 20 bucks.

Funny thing about the service center is regardless of who is right and who is wrong, you will lose every time.

The petitioner does not need to send an original of any of the documents unless specifically asked. If you wanted to be extra cautious the petitioner could send both a photocopy of the birth certificate AND copies of every page of US passport. I sent photocopies of both my naturalization certificate and US passport and my petition was recently approved. Obviously, for me there was no need to send original anything :)

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

No when you have interview in Sydney you will send in your original birth certificate along with all your other documents that they require from packet 3, and they wil have all the info from your USC petitioner there that would have been sent over from NVC.

Your USC petitioner would have sent a copy of his birth certificate with the petition.

Patrick and Chloe the petitioner only needs to send in copies of Birth certificates for 129f petition, front and back. It says clearly on the instructions if born in USA a copy only.
