Here is some background....

My husbands was approved for his IR-1 visa in Jan 2010 (his case went through AP and he was approved after 68 days). My husband was unable to travel within the six months due to a family illness and the visa was never issued. In Sept of 2010, we submited new medical, new police and my new tax documents as per the Embassys request. My husband was interviewed on 10/15/10 and his case was again placed in AP. My husband is in the Venezuelan National Guard and worked in the ONA Office (anti drug office). His visa is currently in AP and I have not had any response from the Embassy. I contacted my congressman and finally received an e-mail from the Embassy stating they would contact me when there is a change in the status. My husband's police record is clear, his medical is clean, there has been no change to our case from the previous AP. My husband stated there is a US agent trying to talk to him to gain information about the ONA office there, I suspect this is why the AP is talking longer now.

Okay, now my questions: the Embassy mentioned the AP had expired. How long is the AP good for? Also, would it be beneficial to submit a hardship letter now while the case is in AP or do I need to wait until the deny the visa.

I'm so happy to find this forum. Thank you for any suggestions.
