Court Marriage Registration in March and then Wedding in May

Hi, I am a US citizen and got engaged in Nov 2010 in India. Wedding is set for at the end of May 2011. I have some time off in March for 1 week and was thinking of visiting India. At this time, I am planning of registering the marriage in court, so I get the K-3 visa process started earlier. Has anyone done this before? Do you think registering the marriage before the actual ceremony would create any problems with immigration (eg. will not have any wedding pics to show as evidence)? Or should I wait to register after the actual ceremony? Any advice is helpful

I don't think it will cause a problem for two married people to file a petition for spouse, no. However, the K3 visa is dead and gone. Follow the CR1 visa guide. That's the currently available spouse visa for newlyweds.

You need to go "American Citizen Section of an Embassy" in India... I know Delhi has a section.

You need to get a "no-objection certificate" from them....it states that

"...................is a american citizen and here in india to get married to ............".

I don't know the exact wording of it....

With this, you will sail through immigration with no issues.

You can file CR1 visa for her with I130 fillings.

Court marriage process takes at least one month. And you better have many pic. of your marriage even at court.

Thanks for the reply...I guess I would be better off filing for the I-130 after the wedding in May, since I will have all the photos (evidence) of marriage. Plus airline tickets are way too expensive and it does not make sense to go just for a week to India. anyways, is a no-objection letter still required after the wedding ceremony in India or does this only apply to a civil court registration marriage?

NOC from Embassy will be required for any marriage registration in India between Indian national and foreigner.
