My B1 Visa was approved Year 1999 but i didnt use it right away coz i was still in school. Year 2005, me and my parents came to the US to visit my USC sister, her hubby and their two kids. We were allowed to stay for a max of 6 months only, so after we reached that period we went back to our country. Two years later me and my mom decided to visit my sister again and that was 2007 and they stamp us 6months of stay. My mom went back to our country before her I-94 expires, but me...Yes i overstayed.. It was sometime around Oct 2009 when i first met my wife then we got married Oct 2010. She was so busy with work and school so it took us 2 months to focus on my case and hire a lawyer. What should i do? I only told my lawyer that i came here 2007 and then overstayed. I disregarded the time i came here in n out legally which is year 2005.

NOV 29 2009 - Met my USC wife

OCT 14 2010 - Got married in San Diego

MAR 03 2011 - AOS package sent to USCIS

MAR 07 2011 - AOS package received by USCIS

MAR 29 2011 - Notice date for all forms

APR 01 2011 - NOA1 receipts arrived

APR 04 2011 - Biometrics appt letter arrived

APR 06 2011 - Biometrics walk-in successful

APR 29 2011 - Notice date for I-485 Initial Interview

MAY 04 2011 - Received Initial INTERVIEW LETTER!

MAY 13 2011 - Received EAD/AP card. Applied for SSN

MAY 19 2011 - Social Security card arrived

JUN 07 2011 - AOS INTERVIEW - Approved!!!!

JUN 10 2011 - Card production ordered!!

JUN 15 2011 - GREEN CARD Arrived!! :)

Call your lawyer, tell them the truth. Tell them anything else you omitted. NEVER lie or leave out information in this process.

Per your prior posts, you are adjusting status. Nothing needs to be done about the B-Visa, you overstayed, it wont get renewed. Also as I said in prior post.

Dont bother with I-131 and AP doc, the overstay WILL bar you from re-entering on the AP doc. You need to wait for Green-Card.

Many people overstayed and then successfully applied for AOS from work, student and tourist visas. It's just a matter of doing your homework right. This website is very helpful, spend some time on it and you will get the answers that you need. Good luck!

ps: whatever you do, do not leave US until you get your Green Card in hands.
