Timeline

I completed G-325, I-485, I-130 and all the supporting documents. Here's the thing, my sister is a joint sponsor and she supposed to mail me the I-864 with all the required documents this week. But unfortunately she has not recieved her Tax returns etc which she requested from IRS. So she told me it'll take 2 more weeks and thats most important document needed for I-864. Should I wait before I file everything?

SEP 07 2007 - Entered US w/ B2 Visa

NOV 29 2009 - Met my USC wife

OCT 14 2010 - Got married in San Diego

MAR 03 2011 - AOS package sent to USCIS

MAR 07 2011 - AOS package received by USCIS

MAR 29 2011 - Notice date for all forms

APR 01 2011 - NOA1 receipts arrived

APR 04 2011 - Biometrics appt letter arrived

APR 06 2011 - Biometrics walk-in successful

APR 29 2011 - Notice date for I-485 Initial Interview

MAY 04 2011 - Received Initial INTERVIEW LETTER!

MAY 13 2011 - Received EAD/AP card. Applied for SSN

MAY 19 2011 - Social Security card arrived

JUN 07 2011 - AOS INTERVIEW - Approved!!!!

JUN 10 2011 - Card production ordered!!

JUN 15 2011 - GREEN CARD Arrived!! :)

yes,

you have to file everything together if you don't want to receive an RFE, requesting the i864 for the joint sponsor.

do you have the i693 medical and vaccination? are you sending the i765 as well?

Oh ok. Yes i do have em already. Sealed and sitting in my files.. So i guess i have to move the day of my filing date.. I dont know why im in a hurry. Maybe bcoz im worried about that backlog thing.

you have to file everything together if you don't want to receive an RFE, requesting the i864 for the joint sponsor.

Yes im sending I-765 for sure.

Are you applying for AOS based on marriage to a USC? THe I-864, with its documentary proof requirements is part of the AOS application (the I-485). Not having complete documents to accompany the I-864 would render the I-485 incomplete and risk an RFE. I would wait until all documents are in place before sending the application off.

You indicate filing an I-130 along with the I-485, from what are you adjusting status from??

Work, Student, Visitor? If Visitor, do you have B-Visa or was VWP??

If Visa Waiver, you may be in for a rough ride, seems USCIS is going hard on AOS from VWP.

Oh my mistake.. Anyways, im on a B1 visa. What's the difference between B1 visa and VWP?

VWP, is a program with some countries where their citizens can visit the USA without a visa, for example Canadians, or British Citizens, and more... the VWP program waives certain rights, and can be much harder to adjust status from.

B-Visa is required to visit from counties without a visa waiver program with the USA or in cases where entry on VWP was denied.

You still may be questioned as to INTENT when arriving on the B-Visa, it's intent is for visiting not immigrations. K-1 fiancee visas have immigrations intent.

Depends on Intent, if the officer at interview feels that the B-Visa was solely used to enter the USA with full intent to immigrate, they can go hard on this. For example being married before entry on the B-Visa, or then long overstay may also make them question Intent.

Visas with much less problems are Work and Student visas, in this case the intent is solid, work, and schooling, and while working or going to school, the visitor meets someone and marries, this is considered normal, and rarely results in any denial over intent.

In most cases of a B-Visa overstay, they do waiver it. Just be prepared to document or convince that immigrations was not your intent when arriving on the B-Visa.
