After they got a shove they gave us an RFE. :angry: Yea my docs as you see my timeline are in embassy. They called me on July 10th asking my birth certificate. I explained them I dont have any bcz my birth was never registered. She said ok we would review other docs which I have sent. I called them on July 24th. I got an answer that the docs are enough and we would be informed for the final interview date. In the meantime our senator(been in contact for two years) sent a letter stressing to process our case. So in the result I got a letter asking my original birth certificate. Thats so unfair. They did tell us before the docs are enough and they dont need anything more. I can imagine how unfair it is.

I-130 petition in DCFR Tokyo: March 14th 2004. Case reffered to DHS USCIS

Four visits to japan in 2004: Oct 2004, wife got pragnant.

Wife/Fiance left USA and moved into Japan: Feb 5th 2005.

Baby Born: June 24th 2005(Japan)

I-130 denied: July 17 2005(Divorce was declared not valid)

Refiling Divorce: oJuly 17th 2005 NY State.

Divorce granted: Nov 17th 2005

K-1 application: Mar 1st 2006

Approval: May 23rd 2006

US consulate RFE: June 15th 2006

FRE sent (Original passports, birth certificate, all origional docs): July 10th 2006

Medical: Oct 11th 2006.

Interview: Nov 10th 2006(expected)

Im sorry they are giving you the run around with this. Did you send them other documentation in place of the BC? Such as baptismal certificate, school records, affidavits from parents or close family relative.

Did you give them some document in place of the missing birth certificate? Like a copy of a school record from where you grew up? That usually works for showing age. Other things is to have a friend of the family make a sworn statement attesting to knowing that you were born to your parents. They would state something like they remember the time of your birth and other events at the time of your birth. Then sign this sworn statement before a notary. That kind of evidence is usually accepted in place of birth certificate.

If still held for RFE I would provide them with additional supporting evidence or seek council of an immigration lawyer.

The book "Fiancé & Marriage Visas: A Couple's Guide to U.S. Immigration" published by NOLO gives all kinds of ideas for additional documentation to substitute for uunavailableitems.

Yes. I have provided them the most important document which is used in my country: National ID. If I have that ID then I can be a presidant of my country. I have given them two school records showing my DOB, father name. The national ID shows my date of birth, age, father name, permannt home addres. But still I guess they are messing with us just like they did since March 2004. :(

The amazing thing is that she is Australian and understands US immigration better than everyone here, with the exception of Yodrak.

To that end, I cannot comment. But, I would follow her advice to the end. It is very good.

ok first of all

Immigration Attorney: Our case is being done through a lawyer. When for the first time i explained her that i cant provide the birth certificate, she said give anything which you have.

Now about your advices: When that stupid consulate girl talked to me on July 10th, she said well you may need parents affadvit. Well i got it the same day and i was waitting if they ask for anything. But as i told you bfre i called on July 24th and i was informed everything is enough and wait for an interview. And now we have been sent a letter only asking abt BC. they didnt even mention about the parents certificate, or school record or anythingelse. I am so pissed off and helpless.

Was it my fault in 1976 that i didnt register my birth? should i be held responsible for it?

From what I read things get lost all the time. I would just send the additional copies of the evidence that you already sent them with the RFE. Sometimes one hand doesn't know what the other is doing there in the government offices.

Send them the affidavit from parents and anything else that you may have. I would also be inclined to resubmit school records if you still have copy of them. Include a letter stating that your birth was never registered so you therefore do not have a BC. Yes you will be repeating yourself but sometimes you have no choice but to. Hopefully this time it will work if it is submitted all at the one time.

ok if you see mytime line then it does show i have provided them the original docs already. my passport, my national ID, school record are already with them. whatelse can i give them? national id is alongwith the certified translation.

i cant fkn fly back to my country now as my passport is in the consulate. i am so helpless. i asked my father to go and get the birth certificate from the union council. i mean they can register it now. is it possible or would it be legal?

I read in a guidebook that you should make alternative evidence on paper.

Make a little folder with

1) statement concerning your birth certificate, and list alternative evidence

2) copies of passports

3) signed testimony by different persons, such as your parents and close relatives

4) signed testimony by the local public administration you have no birth certificate,

but that you are a legal citizen, etc etc

5) try to contact your hospital where you were born to see if they still have records of it.

6) any other proof you can think of

group it, and send that instead of birth certificate in any case where and when requested.

In certain countries, you can correct the situation legally. Contact a lawyer for your options,

or maybe someone on the forum can help you.

Ok, didnt look close enough at your timeline. What about just having your father and perhaps another close family member to do affidavits as you were originally going to do prior to getting the RFE and submit along with a letter stating something like....'as per requested please find enclosed affidavits of support from such and such as further documentation to support the already submtted National ID card etc etc submitted in lieu of a BC which was never registered." It might fly.
