Can anyone answer this: Why did our NOA not indicate at that time something was missing, we received a RFE 5 months after the NOA, anyone experience a similiar situation? We have since sent out the RFE and they received it Jan. 25. Any reassuring thoughts our way will help us deal with the wait and we would be most appreciative to hear back from couples experiencing a similar time frame...THANK YOU !!!!!!

which NOA are you referring to? The NOA1?

The NOA1 is merely an acknowledgment that they received your file for initial review. At the end of that review, that is when they send you an RFE, if any...or an approval if there are no problems with your petition.

After they review what you sent in compliance with your RFE, they should have a decision soon.

The NOA is just a document that states that they agree to process it as is. It means that enough things are there, and signatures are correct, etc. Furthermore, I think the person who initially inspects it is a mailroom clerk, not an Immigration Officer who has power and training to make a decision. The mailroom policy must be to accept any petition they can, and only reject for lack of signatures/wrong fee etc. Then the petition goes in a box for 5 months, because there are so many petitions ahead of it. Then when an IO looked at the petition, they saw there was need to send an RFE, and sent it. Good news is, that your petition is currently waiting on that IO's desk for you to respond, and once you do, then they will send off your approval. Not much more time now. Good luck.

Also, a good read:

Don't panic! Our RFE came 5 months and 2 weeks after our NOA1, and our NOA2 followed 11 days after they acknowledged receipt of our "new" evidence (missed checking ONE rather important box on one form).

Your case is in adjudication! That is great news!

You can get an RFE through the whole process, even at the interview they can give you one.

We received one 7 months after the NOA1, after a service request and an inquiry from the Senator.

NOA 1 only acknowledges your petition submission. NOA1 is a receipt notice and, as you know, they also cash your check right away. USCIS does not look at your packet, at this point, to check for accuracy and completeness. That is what you need to wait months; for an adjudicator to look over your petition packet and decide whether to deny or approve your petition or to request evidence to reach a decision. I hope your RFE is resolved and you receive your approval notice soon. Best wishes!

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

you can click the picture in my signature, it will take you to the ticker website, you can pick from many options. When you made a ticker you like it will give you a code. You need to copy that code then go to your VJ webpage, find settings on the top right corner, go to profile. Then select forum signature, there is a box you paste the code into and save it. The ticker will show up on every post you make after that.

If you click on someone else's ticker it will take you to a website where you can make one, and then go to "edit profile" on the upper right side of your profile page. Once you are there, go to "Change Signature" and you can add one there. I had one but got bored with it and now need to make a new one lol :)

I wish everyone would stop refering to "NOA1" and "NOA2".

The first notice normally received is simply a receipt for your payment. Just call it a receipt notice instead of "NOA1".

The second notice you recieve could either be an RFE or an apporval notice. Both are "NOA2"s but it would end some confusion if an approval notice was just called an approval notice instead of a NOA2.

Just my pet peeve.

Perhaps post your pet peeve, oh experienced one on another forum- ....there are more helpful people here helping us newbies ...perhaps set up a new FORUM for this soul purpose, to educate us all on the correct terminolgy, I seems that most do;however, use NOA1 and NOA2, I will however keep your pet peeve in mind ..cheers
