Janice is there anyway you can confer with this attorney via telephone before you travel home? I see your interview is soooooooo soon. Perhaps there is something he could do in your stead at least until after you have the greencard?

I'm also sorry to say I agree with Tracy about not understanding why Jon can't move to the UK with you. There are children involved here and to this point I don't understand what could be so personal for him that your children aren't more ....well i hate to say it....important.

Yep... I'm with the Queen on this one. David has a 16-yr old daughter who is remaining in Germany with her mother. He understands that I cannot leave my children, ages 14 and 11. That is not to say that we won't relocate to the UK once the kids are 'out of the nest', but right now, they need me. His daughter has a boyfriend and a full life there, and has given us her blessing... my children would never understand my leaving. We made the decision together, based on what's best for everyone. I would hope that Jon would be as understanding... ????

Yes I probably am being too nice but hay Jon is a fantastic fella and has never harmed me in anyway, so yes I am being understanding to his situation, he has been a great support to me and always will be.

Now to more questions if I may..... What would happen if Jon and I went to the interview?? As I said before we both love each other and want to stay married, we are both just a little worried over this part.

As long as your marriage is still intact and you are still a 'couple' I don't see any reason you cannot attend the interview. I presume this decision to live apart is temporary or will be intermittent- many couples have such arrangements. You will just need to remember the rules Lorelle listed above about the length of time you can be out of the US without abandoning your status.

Has Jon ever even visited the UK? If he hasn't I really think he should go over with you, especially as you get this legal process started. He might actually like it over there. I did. Immensely.

And honestly Janice, from some of the things you've posted before about his family, I wonder how he would feel to get away from them - far away. He might find it liberating.

Frankly I do not give a toss what your thoughts are because they are just your thoughts, you have not got a good word to say to anyone although plenty of people have supported you and your situation over the time that you have been on this site. You know nothing of my situation ...only what I have posted on this site, I did not come here to be derived by you so please keep you nasty little comments to yourself, other wise a long list of things will go to the captain about yourself which in all will involve a ban to yourself. No other communication will involve you or I so please leave it at that.

Yes Jon has been to the UK, I am not saying that he will never join me there, just at the moment it is not possible, Both Jon and I have a lot to sort out.

Dear all

I am in a bit of a situation, I miss my children so much that I would like to go back home, I love my husband very much we have discussed this and we are now wondering where we stand. We are going to stay married but we are worried about the potential ramifications regarding problems with USCIS after the AOS process. Are we required to notify anyone of our situation, meaning that I will be no longer living in the USA and yet we both will still be married, which is what we both want. Any help would be greatly appreciated. Thank you for all the support that you have given in the past.

as for the ramifications of you leaving the US, this is one where you actually really DO have to talk with a lawyer, ideally one who knows the topic (few and far between).

You'd be in better stead if you can wait and complete your AOS interview; it may be possible to retain your PR status until you get yourselves sorted.

If you want to leave before then, well, lots of people have binational marriages--there was a woman here at one time who had lived in the US with hubby in the Uk for +10 years. Eventually he was refused entry and had to get an immigrant visa.

There is a way to work it out, don't worry about that, but do think about how you'll accomplish it. You can PM me for a referral to a lawyer who says he specializes in the unusual topic.
