Timeline

my wife filled k-1 visa for me and we got married in december 2010,now am about to adjust my status and here comes the problems

1)are we going to file joint tax return or i should be included as dependant?{plsease not am not working,i came to usa on k-1 visa in november last year}

2)her w2(2010) is ready in her maiden name,now that she is married is she going to use her maiden name to file tax return?

3)if we are going to file joint tax return,how is she going to change her name to her married name?

please enlighten us ,cos we are totally lost.

Timeline

You are not a dependent you are a spouse.

She will file married joint or married separate.

It does not matter if you made no income.

1. She can file joint even if she is the only one who worked, or seperate. Although I heard that when you file joint you get a bigger refund.

2. If the SSA is aware of the name change then she would file using her married name. If they have not been notified, then she would file using her maiden name.

1) file a joint tax return, your only other choice would be to file married separate but that wouldn't be wise.

2) It doesn't matter what her W-2 has, that is just a form that her employer filled out. she needs to update her name with her HR dept but that won't affect her name on her tax return

3)Has your wife changed her name yet at the social security office? She should go to the social security office to get a new social security card. Make sure she brings her marriage certificate with her. This only affects her name though. If she hasn't changed her name that doesn't affect the fact that you are married and must file as married. She should use whatever name is on her social security card.

02/02/2011 Sent checklist back to embassy....Waiting for phone call....

03/03/2011 She had her interview...Lacking of evidence....told her what to get and told her to come back

03/30/2011 She went back to the embassy....This time we had everything...K-1 approved; not in hand yet
