I am sorry to hear this happened to you but I believe Aussiewench and everyone to be correct. Wait for your RFE. It's the process.

Also, I hope CIS doesn't browse through VJ, checking out petitioners. 700 letters? Plotting? Etc....

The process also provides for timelines. If you're out 30 days without NOA1, or 60 days after RFE, etc, you're supposed to call them (Sometimes you get a #######, and may have to try again because somebody else might help... I don't think they talk to each other at all, and sometime sound like they work in different places - always get their names when you talk to them, especially if they promise something) If they do not find your case it may be time to involve a congressman, set up appointment or fax it in, bring all the paperwork they request.

I was waiting 168 days since NOA1 to get reapproved (at VSC where for some reason everyone seems to think time flies!) and it was driving me crazy I called a congressman and prepared all the paperwork to send to them, but since I was within the crazy timelines of USCIS I kept waiting. If you ar outside their timelines, they should have no excuses.

Go ahead and send letters, and get congress rep involved.

the first page is an I-797C, Notice of Action.....REJECTION NOTICE !!!!!!!!

This was the "AMENDMENT" (typed in size 18 font and in red on my cover letter) I sent to CSC with the three new forms of the application with the new IMBRA questions...........I even had my receipt number highlighted on my envelope!!

Anyway......the notice states, " The above application or petition along with any check or other form of fee payment, is attached. The application or petition cannot be accepted because the proper fee of $170 is not attached. Since the case is not properly filed, a priority or processing date cannot be assigned.

Please attach a check or money order for this amount and resubmit this entire package to the address listed below. To speed processing, please leave this notice on top.

Note, the fee for this filing will be $170 if received at INS on or after October 26, 2005.

OK.......what was william saying about the intelligence of these people at the CSC?????????

My cover clearly stated that this was an amended application form for an existing application with the reciept number clearly marked on the cover letter in red ink and with a size of 18 font!!!!!!!!

I do not get this incompetence at all..............Don't they even read these forms and letters when they recieve them?

Did anyone else who sent an amended application with the new IMBRA questions get the same results??????

I know that some of you have already tried this.........let me know.........OK??????

I'm soo sorry to hear this!!!!! We also sent the copy of the RFE to CSC, but we sent it with the letter to the director, not with the new I129F form. We never got any touches like you did right after you sent your 1st letter, so maybe they haven't even seen ours. I hope we don't get the same answer, but I'll let you know in case we do.

We did call our Senator, and they told us CSC said they would send the RFE within the next two weeks. This was of course a week and a half ago and we still don't have it, so we will be calling them again soon.

One thing I think you need to find out, is if your original I129F is still in process. Has your status changed in their website?

Sorry to hear that. May I know what was your amendment for? Our lawyer sent an amendment letter with the new I-129F form to change my address (beneficiary), since there was no way we could do that on the phone. We received the standard email notification that they responded to our request blah blah blah.... just wondering if they would do the same to us. I hope NOT. Thanks

No.........my status has not changed. It still is the same. If they would have just read the cover sheet, they would have seen my reciept number clearly listed and that this was an amendment to an existing petition.

The amendment was the first three pages of the new, updated application with the 3 IMBRA questions. Since I sent in the old form not knowing that there was an updated version. I sent in the application before March 21st.

Now I need to ask you, please ask your lawyer if there was a government form he had to fill out to accompany your amendment.

As far as I know, it's just the amendment letter, new I-129F form and the form G-28 to authorize her. We received an email notification as soon as CSC received the letter. Our lawyer said she will receive a written notification within 30 days, and I got worried when I read your story. I don't want that to happen to us, and I really hope not.

I just wonder why you had to send (amend) a new application when they have your petition already. We used the old form too when we filed our petition in May. I think they only released the new I-129F in late May, so only applicants filing then will have to use the new form. I suggest that you just ignore your notice of rejection, as long as you know your petition is intact with them. There are many of you who filed in March who are still waiting for the IMBRA RFE. CSC really sucks, but you'll be fine.

Aque........thank you. I know if you could help me with your words you would. Believe me, if it wasn't for prayer and God, I wouldn't have made it this far. Today is day 153. I just wish we would have known that this wait would be this long instead of being told 120 days and it will be over. Heck, back in March, we both didn't know how we would last the 4 months. but here it is August.

Like I mentioned earlier, I'm fine until I receive her desperate letters then it gets hard to cope. There's nothing worse for a man or woman than to see their loved one suffer. The helpless feelings are the worst. But, like you said....faith......trust.....hope are powerful allies.

Thank you all for ALL the advice and ALL the comments - pro and con. Now I want to say something.

I am just a humble, man. I am not afraid to admit my tremendous love for my wife. I now that today men have an issue doing this in public but with age comes wisdom. I have learned that there is nothing wrong for a man to admit love to the world to the most wonderful woman alive. And yes, I keep using the title "wife" for my Kat because in our hearts we are already married - regardless of what any government paperwork says or doesn't say. We have committed ourselves to each other for the rest of our lives - period. It does not matter what others think about my words in this post.

AmericanWoman.....your post made sense. I only write that we have exchanged 700 letters because it's the truth and because I thought that the more letters that were written between the two of us the better the proof that our love actually existed. Your right though, they could be reading VJ and thus take this info the wrong way.

I thank Kit for her words of wisdom. And I think she is correct. The system is broken. Someone has to attempt things that have not been attempted before or we will never know what to do or not to do. I am willing to take this risk. Why.....why would I take such a big risk????

Well, I have run out of things to tell my pre-teenaged daughters who constantly ask me when their new friend is coming to us. I am running out of things to tell my wife when she writes desperate letters to me asking when, and why this is happening to us. I am constantly worried for her because she is not just some female looking for a free ticket to America. I won't get too much into detail here, but her situation is a little bit more serious. All I will say is that her life is seriously in danger where she is right now. And her husband that pledges his life to her cannot do a damn thing to help her!!!!!!!! I continuously write letters to her because I dread the day I do not recieve a letter from her. No letters from her is a serious sign of trouble. So we keep writing. Yes, we repeat alot of things over and over again, but who cares, we love to hear them. So we continue to write them.

As many of you all know.......us men are the fixers-of-problems. That is how we are wired. We do things to fix things. Just simply sitting here waiting for a broken system to correct itself is not being constructive or productive from my stand point. I am now continuosly on my knees praying. It is helping me. I am strong today. Normally I'd be all in pieces. But my faith keeps me going.

I had a strange dream last night. I was in the CSC and I found boxes and boxes of all our applications. In the last box I looked into, I found my file all seperated and torn apart. Nightmares????? Yes, I would call this a nightmare about now.

Ok, I will get down from the soapbox now. Note, I admit these things to all not for your pity - but I will humbly and definitely accept all your prayers about now. I'm human like the rest of you all. I'm a man desperately waiting for the woman who pledges to love me for eternity is all.

Now if someone responds back that this is all BS.........oh well..........I can't stop those of you who feel that way. Like Gary once said......."it's pretty much every man for himself now". The world does not care about my Kat or me, or kitkat, or american woman or william or gary or anyone else on this forum. It is too busy trying to make money or start another war somewhere.

Love is becoming a thing of the past every day. I choose to keep it alive. We all have choices to make in this life. I have made mine. Now you all go out there and make your choice of how you want to live your lives.

I didnt mean anything to offend or upset when I asked about your "wife". I was just confused. But you know these CO's will hang on every word sometimes and it may give you a problem when it comes to interviewing, if they are aware of this. I also refer to my fiance as my husband and he refers to me as his wife, for the exact same reasons that you do. We made our commitment in our hearts, to us we are man and wife, all thats lacking is the "legal ceremony". Im sorry that you are finding it so hard to be away from your fiance, but you should know and understand that the visa journey is not always easy for everyone. My fiance and I have been at this for over a year and we have hit every snag possible, and we are looking at maybe another 6 months to a year of fight left to go. Hopefully and prayerfully your petition will go forward now without anymore glitches and you and your fiance will be reunited. But it will help to always be prepared for the possibility that it may be awhile. I learned early on that you can either drive yourself crazy or you can take it one day at a time and survive this hell call immigration. MY best to you!!!

Thank you all for ALL the advice and ALL the comments - pro and con. Now I want to say something.

I am just a humble, man. I am not afraid to admit my tremendous love for my wife. I now that today men have an issue doing this in public but with age comes wisdom. I have learned that there is nothing wrong for a man to admit love to the world to the most wonderful woman alive. And yes, I keep using the title "wife" for my Kat because in our hearts we are already married - regardless of what any government paperwork says or doesn't say. We have committed ourselves to each other for the rest of our lives - period. It does not matter what others think about my words in this post.

AmericanWoman.....your post made sense. I only write that we have exchanged 700 letters because it's the truth and because I thought that the more letters that were written between the two of us the better the proof that our love actually existed. Your right though, they could be reading VJ and thus take this info the wrong way.

I thank Kit for her words of wisdom. And I think she is correct. The system is broken. Someone has to attempt things that have not been attempted before or we will never know what to do or not to do. I am willing to take this risk. Why.....why would I take such a big risk????

Mike - I don't think ignoring the rejection is such good advice, even if your petition is "intact with them". I would make damn sure my petition was still live and not rejected, preferably in writing and not by some moe at the call center.

I just meant he should not go crazy over things and do the right thing this time. His new application was the one rejected and not the one on file, but yes he should correct the mistake he created.

There is a difference in Administrative Review and Administrative Processing. Bala and I were on Administrative Processing for almost eight months. We know there is a difference because whenever we would ask the DOS or Embassy about our "Review" they would correct us and say its "Processing not Review". We did not have any security checks ordered on our case, so our "processing" just involved the embassy "verifying information received at the interview". They made one phone call to my home (my son answered and they concluded I was living with a man here in the states ) and one phone call to Bala's home (and concluded from that call, that he was going to America to work), as far as we know and from what they told us, this is what our "administrative processing " consisted of. And it took a whole eight months to do that. As far as what can trigger it? "red flags". 1) Im older than Bala, 2) Im divorced,3) my ex husband is Asian. There are other things considered "red flags", and each CO can choose what they want to investigate further. No two petitions are alike, no two embassys are alike, and no to CO's are alike. So it just depends on a lot of things as to if you fall into Administrative Processing. Hope this helps. Best of luck to all.

I am so sorry about your troubles Mike...it is indeed the most frustrating and stressful process to go through. Hopefully things will be worked out very soon. I do have 2 advices to give you:

1. Never...ever "ignore" anything the USCIS sends you, even if it is a clear mistake. ALWAYS respond to them.

2. Not only do you have the option of contacting your senator/congressman, but you also have the USCIS Ombudsman:

I would respond to this "rejection letter" exactly as you said you were going to...I would have my senator/congressman follow up on this response. If you hear nothing or get no real answers from the USCIS directly or through your senator/congressman within 2 full weeks, contact the Ombudsman.
