K3 Imbra Question

Hello,

Well normally I don’t post but this has been bugging me for a long time. My CR1 petition has been approved and is currently being processed at the NVC. The K3 visa application on the other hand was originally sent in January. Unfortunately I mailed it to the wrong service center and sent it to Nebraska. They were nice enough to sit on the case for over 3 months before forwarding it to Missouri. My NOA 1 date went from Jan 27 to May 11th. Since then I have been touched once on Aug 12th but I have heard nothing from the service center. No Imbra FRE no nothing.

Since my 1st NOA from Nebraska was pre Imbra dated Jan 27th, and my second 1st NOA from Missouri was post Imbra dated May 11th. My question is do I fall under the new Imbra law? Should I be expecting the Imbra RFE or not?

I called and did a service request today and I just want to know what to expect.

07/31/2006 - NVC generates COA DS-3032 and AOS I-864 bill

08/01/2006 - Express Mailed self generated AOS I-864 bill

08/01/2006 - Emailed COA DS-3032 (no response??)

08/10/2006 - Mailed downloaded copy of DS-3032

08/11/2006 - NVC Received AOS bill I-864

08/14/2006 - NVC Received COA DS-3032

08/14/2006 - NVC generates AOS I-864 package

08/16/2006 - Priority mailed self generated AOS I-864 package

08/21/2006 - NVC generates DS-230 Bill

09/25/2006 - NVC generates DS-230 packet

09/26/2006 - Overnighted self generated DS-230 packet

10/10/2006 - Case Complete!!!!

Embassy:

02/22/2007 - Interview - Passes!!!!!!!!!!!!!!

02/26/2007 - Recieved Visa

03/12/2007 - Scheduled Arrival in Minnesota

Hard to say for 100% surety but I'd hasten a guess that your petition was stamped as received at NSC and it will be the date on the NOA1 and this may explain why you havent received an RFE as it is prior to the IMBRA date of March 6. It was filed with the USCIS and noted as received, just not the correct center. Remember that the NOA1 is only a notice that it was received and the date by which they go by for processing.

Have seen various circumstances in the past that have shown the above to be correct. Out of curiousity, is there any other dates on the NOA1 that you got from NBC (MSC)? Let us know if it turns out to be different.

The NOA1 receipt number from Nebraska had a LIN receipt number, while the NOA1 from Missouri had a MSC receipt number. Two different receipt numbers.

Nebraska:

Receipt Number - LIN-06-085-xxxxx

Recieved Date - January 27, 2006

Notice Date - January 27, 2006

Missouri:

Receipt Number - MSC-06-215-xxxxx

Recieved Date - May 4, 2006

Notice Date - May 11, 2006

The NOA from Nebraska also included an A# while the one from Missouri did not. They only other difference between the two is that the amout received is $0 since I had already paid for the application.
