Worried about supporting my fiance (K1-visa)

Just to add, my 401K, stocks and bonds are all combined together where I work. I have roughly $5,000 or so in my 401K/ pension/stocks and bonds. I will be getting a employment letter together so they can type up a letter of my salary, years worked etc. I make a good salary, I just don't have much in savings. In this economy who can save alot?

So when I file my fiance petition, after approval, I file the I-134 with required proof of employment, etc. got it. Later we adjust status after we get married. Then I would file the I-864 then, ok. Then I'd have to worry about a co-sponsor? What if we couldn't get a co-sponsor? Would he be in limbo until we'd find a co-sponsor? What would happen? He just couldn't change status until a co-sponsor is met?

Can he file for a permit to work, and find a job and have his employer sponsor him? Does that sound out there as an idea?

The longer your husband (that's what he will be at that point) sits in the US without a status adjustment, the longer he cannot work or travel.

He also becomes an alien without a legal status insofar as the Service is concerned. It's far reaching, but he could be removed.

Can he file for a permit to work, and find a job and have his employer sponsor him? Does that sound out there as an idea?

You could file for an EAD (employment document) after he arrives, but it's only good for the length of his visa. 90 days. It's worthless and the 90 days would likely be near to expiry by the time you got the document.

I know the boys around here are going to think this is nuts, but I think your efforts would be better concentrated on finding out if YOU were the sponsor of your ex sister in law and her children. I'm thinking you were not.

But it's going to take some serious Googling to find out HOW to find out.

If I were you, I'd shuffle on over to britishexpats.com and look for the member Meauxna. She's the wiz of them all at helping figuring out the affidavit of support.

What if those 3 people i prevously co-sponsored 8 years ago i dont put on the forms? Does the uscis not look back more than 5 years? A friend of mine has a lawyer friend that did her immigration paperwork for her husband and her. she said she didnt think i'd have to list them. If this correct? I'm so confused..

With my fiance, me, and my two kids i am financially able to support him with us. I even have enough in income and assets to help 5 in a household. That means i'd be short income for at least two people.

I think it all boils down to when my fiance who will eventually be my hubby will have trouble adjusting status when we will have to worry about those 3 i previously co-sponsored? These 3 people are all permanent residents, they financially support themselves. I have never supported them financially as far as bill paying, borrowing money, etc.

Please give me your thoughts. I really dont think i have to list them on the I-134 or I864 form. help!

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Ok i will list them. How do I or when will i know if they'll become citizens? Do we have to wait a couple of years before we can even think about applying??Everyone has said no as far as co-sponsoring with me. What are we to do? We cant ever be together? We love each other very much!! I feel soo soo sad. We are stuck. so he'll have to visit me every two years until those 3 become citizens?

I would list the people for whom you submitted a signed affidavit of support but I would also explain how long ago it was, that you were signing as a household member and let them know anything you know about their current status as citizens, residents or fully employed. Let the Consular officer consider the totality of the circumstances and hope for the best. The Consular officer will know how unlikely it is for you to ever have any obligation to support these people.

Later, at the adjustment of status stage, do the same with the I-864. USCIS will know their status but you can offer your explanation as well. I think you missed the suggestion of a letter of explanation in one of my earlier posts.

I would list the people for whom you submitted a signed affidavit of support but I would also explain how long ago it was, that you were signing as a household member and let them know anything you know about their current status as citizens, residents or fully employed. Let the Consular officer consider the totality of the circumstances and hope for the best. The Consular officer will know how unlikely it is for you to ever have any obligation to support these people.

I am wondering if the OP's fiance has any money saved up. And if so how much.

My fiance is currently saving money every month to pay for jabs, interview, plane ticket, etc. I have money for the K1 petition, and will be saving up for the AOS as he wouldnt be working straight away. We are still waiting if last person we asked will say yes as my cosponsor, because I know I'll need one.

It would help you to read the K1 guide/flowchart so you're sure you understand exactly what will be needed from you and when during the process.

Thanks, have done my research. I have the packet ready to go. Just have to make sure I make enough so my fiance can adjust status later. I have full time employment, 401k/pension. We have a friend that might be able to co-sponsor. If I don't need a co-sponsor, then its ok, but think i might need one.

I make an average of $26,000 a year. I worked alot of overtime this year and end of year paystub says I made $32,000, I get $6,000 a year in child support (oldest child will be 18, August 2011, so am on a timeline),I have 5,000 in a combined 401k/pension/stocks.(all rolled together through work) Does that sound like I still need a co-sponsor? I think I still do. I am saving as best I can, am filing taxes soon and putting any refund in savings too.

I would have a household of 4, me, fiance, and my two daughters. But...I co-sponsored 3 people (ex sis in law and her two kids) in 2003. So I am responsible even if I got divorced, bringing my household to 7. They are all 3 permanent residents only.

Thoughts? :blink: Co-Sponsor, yes?

I would be calling USCIS, asking to speak to a supervisor, and see if they can guide you to find out if YOU were the sponsor of those three people, or if your ex husband was.
