We were barely married (court part) for only 2 months and the religious marriage wasn't yet consummated so NO, we didn't live together. And the only proof brought to the interview was notarized testimonies from friends, pics from engagement party etc and that's it. And yes, it was approved without the evidence you mentioned. I brought my phone records to show that I called her but the IO didn't want to see it. In my case, there really was no other way but to be apart for the first 4 months of marriage (married in January, graduated and moved to FL in May). I believe, however, that in my case the whole cultural ordeal played a huge role at AOS. My ROC included 300 pages (some were printed on both sides) of evidence that certainly was an overkill. My marriage lasted 1 month shy of a third anniversary, so an interview wasn't necessary.

My point is, it's really IS case-by-case and there's no way to generalize. At the time of the OP's AOS, they certainly found enough evidence to deem their marriage legitimate and a greencard was granted. That same evidence will be recalled to adjudicate his current case. Removing conditions for the OP can be a breeze if the IO/USCIS focuses on their joint residence in Italy which, according to OP, spanned 1.5 years or something. But ROC could be a nightmare if USCIS considered only the part following their move to the US. Just like Jim said, they may think the entire marriage was solely to gain her trust and enter the US as a PR, then decided to end it. And the fact that they separated upon entry to the US may support the latter suspicion and trigger further complications.

Let me clarify: I did NOT come to the US for immigration purposes!! Dammit, I am from the European Union, had a decent job, and came to the US primarily because my wife couldn't find a job there. That being said, these are the proofs I could show:

- Some printed emails from 2007 related to my relationship with my wife before marriage;

- Many emails from summer 2009 till today proving that we emailed each other VERY often when I had to go for 2 months to work abroad;

- Joint bank account in Italy with debit card in my wife's name;

- I owned a house there, and we lived together. I can get affidavit from people in italy affirming that.

- I bought her tickets to come to see me while working in Asia.

- We travelled together a lot during our marriage! I have pics from Las Vegas, Turkey, Indonesia, Hong Kong, Cambodia, Thailand, France together.

- Happy holidays letters sent from my wife's family to both of us;

- Pictures of my family with her family in Japan and with her family at our wedding in Italy;

- Proof of me paying for her university's tuition in Milan;

- Pics of me in KC with her family for her graduation (we met in the US while I was an exchange student there, then she moved to Italy with me).

Once in the US, we didn't last long, still our relationship was normal at the beginning (for the first two months).

- As said, we can explain why we didn't live together. She was working in the Philly Area (it was between there and DC, so I did NOT lie!) and I was studying in NY;

- We took a trip together to Jamaica after I entered the US. I have many pics of it;

- I have pics of her coming to see me at my location; my house owner can witness that;

- I have phone made phone calls to her grandma's location when she was there and I have skyped her multiple times.

Yes, we didn't not have the time to set up a joint bank account, or a joint phone bill, but we didn't see the reason why to do that since we didn't live together at that point. I know it's strange, but while my marriage may had had some problems when I came here, I was totally sure I loved her and certainly had no intention to leave her. Once here though, the distance, the fact that were both very bus, she gettign mad at me because I had a social life not including her made things falling apart.

Also, after we broke up, I have tried to contact her many times, but she refused to reply. She changed her phone number as well, and I cannot locate her. I have been super busy at school, and that made things worse. I have tried to offer her counseling via email lately to try to save our relationship, bt she didn't reply.

No, the rule is that they must have entered the marriage in good faith and not primarily to secure an immigration benefit. There have been many cases of relatively long relationships where there was little or no prior indication of fraudulent intent right up until the immigration benefit was obtained, and then things changed drastically. For example, maybe the foreign spouse arrives in the US and does a runner, or maybe the relationship changes dramatically soon after they arrive in the US, or they live apart since arriving in the US, or the foreign spouse has another relationship "on the side" or develops another relationship soon after immigrating.

They look closely at what happens shortly after the immigration benefit is obtained to see if perhaps this is all they were waiting for before making dramatic changes. Long term relationships don't usually fall apart suddenly unless something serious happens to change it. Being separated from each other for a few months is not usually enough to break down a long term relationship. Most people on VJ were separated from their loved ones for longer than a few months - multiple times - and their relationship weathered this just fine. It's going to look suspicious to an IO.

So, I and my wife weathered a distance relationship once, for 7 months, before getting married. So it's NOT the distance the primary cause, it's the whole new situation that made me discover things weren't alright anymore. Is that so weird>?!!!> Should have stayed with my wife and suffer while making her suffer just because it looked suspicious to an IO?!? #######?

And you know what? I tried to email her, regularly, in the past 2-3 months! SHE changed her telephone number, not me! What else can I do>!?!? hire a detective>!>!>!>????
