Good finding, Bailey.

This is the one from that page which gave me concern in this instance:

"Multiple criminal convictions.-Any alien convicted of 2 or more offenses (other than purely political offenses), regardless of whether the conviction was in a single trial or whether the offenses arose from a single scheme of misconduct and regardless of whether the offenses involved moral turpitude, for which the aggregate sentences to confinement 2/ were 5 years or more is inadmissible."

The deportation from Belgium would concern me, too, as I believe that one of the consular visa forms (maybe the DS-157) asks if one has ever been refused a visa, denied entry, or deported from any other country.

Nevertheless, if his hooligan days are well behind him, he might well be all right. But I think Tracy's given you sound advice, and to that I would add: Consult with a lawyer familiar with I-601 waivers for crimes involving moral turpitude and deportation as a result thereof. A lawyer would be able to tell you if he'll need a waiver and what his chances are of having it approved. Then, if he's denied at the interview, you can have the waiver ready to go right away.

If this were me, I'd continue with the process as normal and be prepared to file a waiver at the interview just in case.

I'd agree with Tracy. Plus, I remember that incident on the news.... it was pretty bad I have to say.

I suppose if it was soccer related then they might realise that there is no way he could get involved in any activity like that in the USA!.

Strange how some react though, I once saw Iceland vs Wales in Iceland and everyone was really friendly towards each other, including sharing a few beers! No violence, no crowd seperation, just a fun event (Wales won 4-0 BTW)

I dunno for sure how police reports work, but would it show an arrest and then say 'soccer related'? :blink: I wouldn't think so.

Those crazy English, just can't behave themselves like there northern neighbours. ;) just joking.

You will more than likely have to file I-601 waiver. It shouldn't be too hard as he has had a good record of recent, though you will have to prove hardship on the USC's side. You'll be ok.

A good lawyer will tell you that 95-98% of all cases for a fiance visas do not need a lawyer but i would suggest with a prior deportation and assualt type of arrest you may fall into the 2-5 percent that does . research and find a good lawyer and at least just pay for a consultation to understand the possible hoops you may have to jump through .

I dunno -- this could actually be bad, especially in a world cup year. I imagine there will be a huge ratcheting up against people with past hooligan-related arrests in the run-up to Germany, and your fiance could well find himself on a list of people banned from entering the EU/leaving the UK around that time. I'd definitely consult with a lawyer -- good luck!

You might give this a try. She is a lawyer who does waivers for immigration. She has a free chat on Wednesday. Not sure what time but It should say on her site.
