Hello all

Is it critical for myself and wife to send in certified copys of our divorce decree's for the I-130, or will a standard copy be enough? I know that the marriage certificate has to be certified, but not 100% for the divorce papers.

Nope,if in case it gets lost,,then go get another copy from the court house.They only accepts certified copeis not standard one.

For I-130s, photocopies of original documents will suffice.

At the Embassy interview, the non-USC spouse must bring the certified copy of the divorce decree and a photocopy of the document. (The Embassy usually takes the photocopy after verifying the information and authenticity of the certified copy).

For I-130s, photocopies of original documents will suffice.

At the Embassy interview, the non-USC spouse must bring the certified copy of the divorce decree and a photocopy of the document. (The Embassy usually takes the photocopy after verifying the information and authenticity of the certified copy).

I think at this point to be safe rather than sorry, we will send in certified copies.

Photocopies will do..But make sure during the interview it a must to bring the certified copies for verification purposes.

You're getting some conflicting information here. Your profile indicates adjustment of status, and you posted in the adjustment of status subforum, so I presume this is for an AOS filing and not a visa application, so no embassy or consulate will be involved.

USCIS doesn't require an original copy of anything except for forms that contain your signature. All other evidence can be a plain old photocopy. If there appears to be a discrepancy in the photocopy then they may ask to inspect the original document, either by sending an RFE or by requesting the document at the AOS interview. An example of what might trigger this is if the photocopy appears to show that a correction was made on the original document.

A certified copy of a divorce decree is one that contains a stamp from the court clerk certifying that it's an authentic copy of the original document in the court's files. USCIS will almost always accept a photocopy of a certified copy, but they will look to see that the original contained that stamp. The same applies to a marriage certificate. You can send a plain photocopy, as long as the photocopy shows that the original was a stamped certified copy.

Always bring the originals to the interview. The IO might ask to examine them.

Thanks Jim, I appreciate the info you have given. This is a long story and different route in which I should have taken but in the past. My wife(petitioner) is filing the I-130 as we will be married 2 years in March this year. Reason for that as we have been advised by VJ members to go that way. We went the K1 route before and I arrived in the US Dec 08 and got married March 09 but didnt file the AOS. So going for the 10 year GC instead of the 2 year GC. We will be sending of the documents exactly on our 2 year anniversary.
