UK girl married US boy within VWP, now less than 180 days overstay, advice!

The only relationship evidence I sent was the marriage certificate, a boat insurance policy that happened to mention my name alongside my husband's, and three affidavits from in-laws and a friend saying basically "I know X and was present at his marriage to Y." I was approved no problem.

I've not left the US yet, I am still with my man, but reading some of the stuff on here is making me dread leaving him, as there's a chance I won't see him for the whole of 2011 apart from whatever plane fares we'll be able to scrape together for him. And they wonder why people go illegal...

On the I-130, it asks if I'm still in the country. We are hoping to file ASAP, but I won't be leaving to return back to the UK until Feb 28th, so should I say this in the covering letter? Or shall I just say I'm back in the UK already? I don't want to look like I'm lying, but I also don't want to over complicate things.

I would put Yes but a notation that you will be leaving on that date.

I was still in the US when I filed - get it in as soon as possible! I put that I was, but in the later question it ask if you are adjusting status and if not, which embassy abroad will you be filing at. I felt it was clear so left it as that!

One of the most important things is to always tell the truth. If you aren't sure what the truthful answer is (eg because of a badly worded question) then ask on here. If you are worried the truth is complicated and will be misunderstood, still tell the truth and ask on here to either be reassured or advised as to whether you should provide an explanation.

I need to get my head around this, I've read loads of guides but they just confuse me more.

So, I file the I-130 package, with the G-325a forms and all the evidence, and include a covering letter explaining flying home with flight confirmation. Then, when I get home, I wait for more forms to be sent back to me. Is that right?

Are there any other forms I need to start filling in now? Does the I-130 automatically start the next step of the procedure?

Youve essentially got it! I-130, 2 x G-325a plus a G1145 if you fancy it, along with the supporting evidence. Then you sit on your bum and wait! You'll get the NOA1 (notice of arrival) and then start researching the NVC stage.

Oh, and most importantly, DONT FORGET TO INCLUDE THE CHEQUE!!!!
