Hello everybody,

came in US 06/06/09

visa F-1 (esl courses)

got married 11/12/10

I am almost done with my package AOS

still few questions like

do I have to send my I-20 with the package ? or they will ask it during the interview

I ask because my I-20 will expire on 02/01/11

I think about to send my package on 01/24/11

01/31/11 - Day 005 - Checks cashed

02/09/11 - Day 014 - NOA received in the mail

02/14/11 - Day 019 - Received Biometric appointment dated 2/2/2011, for 2/24/2011

02/24/11 - Day 029 - Biometric done

02/28/11 - Day 033 - Called USCIS regarding not seeing my cases online

03/24/11 - Day 057 - 2 receipts number appeared online EAD & AP approved

03/29/11 - Day 062 - USCIS ordered production of the EAD card

04/02/11 - Day 066 - EAD & AP "combined" card received

04/05/11 - Day 069 - Apllied for my SSN

04/11/11 - Day 075 - Social Security Card received

06/06/11 - Day 131 - Started to work - my bday - my second year in USA

08/22/11 - Day 1?? - Received by mail AOS interview on 09/26/11 @ 1:45pm Federal Plaza

08/27/11 - Day 1?? - Received by mail Cancellation of the interview.

08/29/11 - Day 1?? - Received by mail AOS interview on 10/03/11 @ 9:00am Holtsville (Long Island)

10/03/11 - Day 1?? - Green Card Approved "On October 3,2011,we ordered production of your new card" (appeared online)

Hi! I'm also preparing my AOS application and I asked a similar question in this forum before. It seems that once we apply for AOS, our F-1 status is void, so I-20 doesn't have any value anymore. And USCIS requires us to send the original. I hope more experienced people in this forum will help you with the specifics about the dates.

AOS from F1

February 18, 2011 - sent via FedEx

Feb.19, 2011 - delivered to Chicago Lockbox

Feb. 28, 2011 - NOAs received

March, 2011 - biometrics letter received, biometrics completed

April, 2011 - Employment card arrived

June, 2011 - Interview notice for July interview

July, 2011 - Interview successful - GC received

what's happen

1 - if the process start before 02/01/11

2 - if the process start after 02/01/11

My I-20 will be expired 02/01/11

so in which case, I stay legal or illegal, still student or no more student

I also know that after my I-20 expire, you can stay 30 days legally after your I-20 ended

I am really confuse

h4kim,

Once you apply for your AOS, your I-20 is not in effect anymore and you're legal. I'm not sure about what happens if you overstay a visa (probably nothing in your case because of your grace period), but if you're really worried about it, send your AOS through Fedex Overnight or something so they'll get it right away. My package got there in two days and my first touch was a week after that.

You should be ok.
