A WIDOWER USC FILING I-130 FOR CHILDREN

HI

My dad is USC. my mom died recently. my dad never married after that.

now he is planning to apply for kids immigration.

i have few questions regarding that I130 please help me.

Tell me if i am answering it right or not. this is how i answered

marital status:widow

date and place of present marriage:N/A

prior husband/ wives name: name of deceases wife

date of marriage ended: death date of wife

along wid I130 what documents he have to send?

birth certificate of kids in native language

birth certificate of kids with english transalation

naturalization of my dad citizenship

filing fee $420.00

what else do i have to attached?

my moms death certificate?

or parents marriage certificate?

plz help me

remm my dad once married once and had kids from that wife. wife died recently and dad never married.

he is widower

please tell me if he is filing I130 right?

he is confused if he have to send death certificate or marriage certificate with I130

--copy of marriage certificate, translated into english if needed

--copy of death certificate, translated into english, if needed

Darnell.. the sponsor would submit copy of his marriage cert./ death cert. even though the information was not requested at this time to establish the family relationship for uscis's requirement..?

it means that i have to send both

death certificate and marriage certificate

what if the last name of my mom on death certificate is different then marriage certificate

on marriage certificate last name of my mom was the name before marriage

on death certificate her last name is the name of my dad

in other words last name was changed after marriage

is that going to be a problem if i send death certificate and marriage certificate?

birth certificate have the name of both parents mom and dad

my moms name on birthcertificate of all the kids is the name after marriage.

Yup. Some ppl say a birth certificate on the child is enough, but I claim must show 'something' on the marriage with the mother, as well. But hey - lets knock this around a bit, wait for some more input today, ya?

are there any ID numbers on these documents? ID number of the mother? do the ID numbers MATCH on marriage certificate, birth certificate, certificate of death, or not?

when my mom got married in the old times she didn't have her id on marriage certificate

but the death certificate have name of my mom with native id number and it says wife of ---------(my dad)

my mom been into immigration process in the past and she was granted a immigrant visa in the past with the same name that was after marriage.

my point now is that if i send death certificate that has name after marriage(the same name she been into immigration process as a spouse of USC)

and

marriage certificate that have name before marriage

is that going to be a problem to different name?

or should i just sent death certificate and if they need more information they can ask me

please suggest me what i should do

i'd include a one page letter about the name of the deceased spouse, covering time periods between marriage, birth of children, and death, just to 'be certain'.

USCIS adjudicators usually are 'quick readers' - so if the EVIDENCE is clear, and backed up by a CLEAR LETTER that explains it CLEARLY, yer golden. Usually.

hi

i was checking USCIS website and got this information

read it

you must submit these documents with I-130 if you are the Biological father

1) A copy of your child’s birth certificate issued by civil authorities

2)A copy of your marriage certificate to the child’s biological mother

3)If you and/or the biological mother are no longer married, you must also submit evidence of the legal termination of that marriage through death, divorce, or annulment.

4)If you never married the child’s mother before the child turned 18: If the law of your or your child’s residence considers the child legitimated, you do not need to provide additional information

5)If your child is not legitimated under the law, you must submit evidence that you established a bona fide father-child relationship prior to the child turning 21 or marrying. This should be evidence of emotional and/or financial involvement in the child’s life.

madeel - yup - that's why I suggested the marriage certificate, birth certificate of each child, and the death certificate.

The 'list' you pulled from USCIS instructions was engrained in the deep recesses of my brain, but I wasn't able to quote the source, just suggest which documents. Thankfully - my list matches up with that list - so you'll be GOLDEN - but -

remember - only submit photocopies, showing any seal or stamp or registrar's notice IN the photocopies, as well.

re: her name (sorry, not answer this before) COVER THIS in a paragraph in the letter that yer writing that describes the marital 'lifespan' .

yup darnell u was right.

i did the same way you told me but one day i was checking on uscis website and i found this information so just wasted to share.

you know sometime ppl ask questions like i asked but then when you provide them asnwer they wants to be 100% sure that ok is this the right thing we are suppose to do.

like me i got all the documents you told me to that i should send along with I 130 but still i was reading online more information and got this link..

so now for others it will be very helpfull.they will be 100% sure and will have peace of mind after they will do it.
